What a Bodyshop Service Agreement Covers

A Bodyshop Service Agreement is a written contract between a vehicle owner and an auto body repair facility that documents the scope of repair work, price estimate, parts authorization, and responsibilities for payment and storage. It typically includes authorization to inspect the vehicle, pursue insurance claims on the owner’s behalf, and set timelines for completion and pickup. The agreement also addresses liability for damage, warranty terms for parts and labor, title retention for unpaid balances, and procedures for dispute resolution and mechanic’s liens where applicable in the United States.

Why documenting repair work matters

A clear written agreement reduces disputes by defining services, costs, and responsibilities in advance, and helps with insurance coordination and lien protection.

Why documenting repair work matters

Who typically completes a Bodyshop Service Agreement

The agreement is completed by parties who need clear authorization and a written record of vehicle repairs and related financial obligations.

  • Vehicle owners and drivers who want written authorization for repairs and cost estimates, including insurance claim consent.
  • Bodyshop managers or service advisors who must document scope, parts orders, labor rates, and completion deadlines for shop operations.
  • Insurance adjusters and claims representatives who rely on documented authorization and estimates to approve payments and subrogation.

Signed copies serve the vehicle owner, repair facility, and insurer; copies should be retained per recordkeeping rules and for potential lien or warranty claims.

Core elements to include in a professional agreement

Include specific, enforceable clauses that cover authorization, costs, parts, timelines, liability, and dispute resolution so all parties understand obligations and remedies.

Scope of Work

Describe repairs in specific terms, including damaged parts, services to be performed, and any exclusions; avoid vague language that creates enforcement disputes.

Estimate & Pricing

Provide itemized labor rates, parts costs, taxes, and potential supplements for hidden damage; state whether estimate is binding, capped, or subject to change after inspection.

Authorization

Owner signature authorizes inspection, repair, and, where applicable, insurer contact; include explicit consent to order parts and to dispose of replaced parts if required.

Payment Terms

Specify deposit requirements, final payment due date, acceptable payment methods, late fees, and consequences of nonpayment including storage and collection procedures.

Title & Lien

State whether the shop retains title or an ownership interest for unpaid work and describe mechanic’s lien rights and required notice procedures under applicable state law.

Warranties & Returns

Define warranty periods for labor and parts, procedures for warranty claims, and whether warranty is limited to specific components or workmanship.

Where signed agreements are sent and stored

Define routing so signed copies reach the vehicle owner, shop records, and insurer without manual transfer and so audit trails are preserved.

  • Customer Copy: Owner receives signed PDF
  • Shop Records: Store in job file and digital archive
  • Insurer: Upload or email claim documents
  • Third Parties: Send to lenders or lienholders as required

Digital signing and file format considerations

Use a platform that supports common formats, strong audit trails, and configurable authentication to meet legal and insurer requirements.

  • File Formats: PDF and DOCX supported
  • Integrations: CRM and shop systems
  • Audit Trail: Timestamped signature history

Typical timelines and deadlines to track

Track acceptance windows, claim filing, storage notices, and warranty periods to avoid penalties and ensure timely customer communication.

Estimate Acceptance Window:

Customer should accept within 7–14 days of estimate

Insurance Claim Filing:

File promptly; many insurers require immediate notice

Storage/Lien Notice:

State notice timing varies; begin process after nonpayment

Warranty Period:

Typically 30–365 days depending on shop policy

Record Retention:

Keep records at least 3 years for tax purposes

Common mistakes to avoid when preparing the agreement

  • Using vague descriptions of repairs that create scope disputes and extra charges later.
  • Failing to capture insurance assignment or claim authorization before ordering parts.
  • Not specifying payment terms or storage fees, which complicates collection and lien enforcement.
  • Allowing unsigned change orders for additional work, increasing liability and customer complaints.

Potential penalties and legal risks

Insurance Denial: Claim payments withheld
Lien Challenges: Improper notices may invalidate lien
Storage Costs: Accruing fees and legal exposure
Breach Claims: Customer may seek damages
Regulatory Fines: State consumer protection fines
Tax Record Issues: IRS record-keeping penalties
