What the Borrower Disclosure Form Is and When It’s Used

A Borrower Disclosure Form is a written record provided to a loan applicant that itemizes key loan terms, borrower obligations, required disclosures and any material facts the lender must report under federal or state law. It commonly appears during the loan application or underwriting phase for consumer and commercial credit, and is used to show the borrower received legally required information about rates, fees, prepayment penalties, collateral, and servicing. The form helps document consent and creates an auditable record for compliance and future dispute resolution.

Why a Clear Borrower Disclosure Form Matters

A complete disclosure form protects both borrower and lender by documenting material loan terms, facilitating informed consent, and supporting regulatory compliance under federal statutes such as the Truth in Lending Act and state consumer protection laws.

Why a Clear Borrower Disclosure Form Matters

Typical Users and Roles for This Form

Lenders, loan officers, mortgage originators and borrowers are the primary users; compliance teams and closing agents also rely on the document to confirm required disclosures were made.

  • Loan officers and underwriters preparing loan terms and verifying disclosure delivery.
  • Borrowers signing to acknowledge receipt and understanding of material loan terms.
  • Compliance or closing agents maintaining the form as part of the loan file.

Use this form whenever a loan application moves to underwriting, before closing, or when law requires advance written disclosure of specific terms.

Who Signs and Why

Borrower

The individual or entity applying for credit signs to acknowledge they received and reviewed loan terms. The signature documents consent and establishes attribution for enforceability and retention requirements.

Lender

A lending officer, authorized signatory, or closing agent signs to confirm the lender provided required disclosures and to certify the accuracy of information delivered to the borrower.

Core Elements a Professional Borrower Disclosure Form Should Include

A professional disclosure form organizes information so borrowers can compare offers and lenders can demonstrate compliance. The document must balance legal completeness with clear, reader-friendly layout.

Loan Terms

Itemize principal, interest rate (APR), payment schedule, balloon payments, and amortization assumptions so the borrower can understand total cost and timing of payments.

Fees and Charges

List origination fees, closing costs, third-party charges, prepayment penalties and any service fees; include dollar amounts or formulae used to calculate variable fees.

Collateral and Security

Describe collateral type, filing obligations (UCC or deed), lien priority, and borrower responsibilities for maintenance and insurance where applicable.

Default and Remedies

Explain events of default, cure periods, late fees, acceleration rights, and lender remedies including repossession, foreclosure, or setoff procedures.

Consumer Notices

Include legally required consumer disclosures such as Truth in Lending, RESPA notices, privacy statements, and any state-specific warnings in plain language.

Signature & Attribution

Provide a clear signature block with printed name, title, date, and witness or notarization fields if required to establish attribution and legal effect.
