What a BOV Agreement for Real Estate Is and when it’s used

A BOV Agreement for Real Estate (Broker Opinion of Value agreement) documents the engagement between a property owner and a licensed broker to prepare an estimated market value. The agreement defines scope, access for inspection, the valuation method (comparables, market analysis, or desk review), delivery timeline, and any fee or retainer. A BOV is advisory and not a certified appraisal; it guides pricing, listing strategy, or internal decision-making. Parties often use a written BOV Agreement to set expectations and limit liability, and the agreement can be executed electronically under applicable e-signature laws.

Why organizations rely on a BOV Agreement

A written BOV Agreement clarifies responsibilities, timing, and payment, reduces disputes about scope, and documents the broker’s methodology and limitations. For sellers, lenders, or investors it provides a timely market estimate without the cost or delay of a formal appraisal. Electronically signed BOV Agreements meet U.S. e-signature law requirements (15 U.S.C. §7001; state UETA provisions) when intent, consent, attribution, and retention are present.

Why organizations rely on a BOV Agreement

Typical users and roles that complete a BOV Agreement

The BOV Agreement is used by multiple stakeholders who need an expedited market value estimate and a clear contract for the broker’s work.

  • Licensed brokers and agents who prepare comparative market analyses and document valuation methods for clients.
  • Property owners and sellers who require a written valuation and engagement terms before listing or negotiating.
  • Lenders, investors, attorneys, and asset managers who use the BOV as a quick reference for underwriting or transaction planning.

Parties should confirm broker licensing, signatory authority, and whether the estimate will be relied upon by third parties such as lenders or buyers.

Step-by-step: completing a BOV Agreement

Complete the agreement in the order below to ensure required information is captured and signatures are valid under e-signature rules.

  • 01
Prepare the file: Gather title info, MLS/parcel ID, recent comps, and property photos.
  • 02
Send to broker: Provide the completed fields and attachments for broker review.
  • 03
Schedule inspection: If included, arrange property access within the agreed timeline.
  • 04
Receive BOV: Broker delivers report and signs; parties execute the agreement.

Essential components of a professional BOV Agreement

A thorough BOV Agreement balances clarity, limited liability, and actionable valuation details so recipients can rely on the estimate within its defined scope.

Scope of Services

Describe whether the BOV includes an on-site inspection, marketing analysis, or only a desk review; specify deliverables such as a written report and comparable sales list.

Property Identification

Include full legal description, address, parcel or MLS number, and any unit identifiers to ensure the valuation applies to the correct asset and public records.

Valuation Methodology

State the methodology used (CMA, income approach, market approach), key assumptions, and date range for comparables to document the basis of the estimate.

Access and Inspection Terms

Set dates and conditions for property access, seller obligations for providing information, and who bears costs for inspections or third-party reports.

Fees and Payment

Specify compensation, billing schedule, refund policy, and whether payment is contingent on report delivery or other milestones.

Limitations and Disclaimers

Clarify that a BOV is not a certified appraisal, identify who may rely on the estimate, and include liability caps or indemnities where appropriate.

Required identifying information and data fields

Property Address: Street, city, state, ZIP
Owner / Client: Full legal name
Broker Details: Name, license number
Effective Date: MM/DD/YYYY

How to configure an online BOV workflow

Standardize the digital workflow so signers receive, authenticate, and complete the BOV Agreement in the correct order.

Document Workflow Configuration Header Row Setting | Value
Authentication and Signer Verification Settings Email plus optional SMS code
Signature Type and Evidence Captured Electronic signature with audit trail
Attachments and Required Evidence Photos, MLS sheet, inspection notes
Routing and Approval Order Owner -> Broker -> Third‑party reviewer

Typical online execution flow for a BOV Agreement

A consistent signing flow reduces errors and supports legal proof of execution when contested.

  • Upload Documents: Sender uploads agreement and supporting files
  • Place Fields: Add signature, date, and input fields
  • Send to Signers: Dispatch by email or signing link
  • Complete and Archive: Signed copy and audit trail are stored

Technical and format requirements for e-submission

Ensure the chosen platform produces an audit trail (IP, timestamp) and stores the signed document in a tamper-evident format for the retention period required by law and internal policy.

  • File Formats: PDF and DOCX are preferred
  • Integrations: Supports CRM and cloud storage
  • Authentication Options: Email, SMS code, KBA

Common timelines and delivery expectations for a BOV Agreement

Typical agreements define measurable deadlines so both broker and client understand inspection windows, report delivery, and review periods.

Inspection Window:

Broker inspects property within 3–7 business days after access granted

Draft Delivery:

Initial BOV report delivered within 3–5 business days post-inspection

Client Review Period:

Client has 5 business days to submit comments or request revisions

Final Report:

Finalized report delivered within 2 business days after client approval

Record Retention Trigger:

Retention period begins on the Effective Date

Common mistakes when preparing a BOV Agreement

  • Failing to identify the precise parcel or unit leads to an inaccurate comparables set and potential dispute about which property the BOV addresses.
  • Using vague valuation language (eg, 'approximate value') without method or date reduces the utility of the report for third-party reliance.
  • Omitting inspection terms or access windows causes delayed inspections and may invalidate time‑based assumptions in the valuation.
  • Neglecting to limit reliance or disclaim liabilities can expose the broker to excessive damages claims in downstream transactions.

Risks and potential liabilities for incorrect or incomplete BOV Agreements

Mispricing Risk: Lost sale opportunities
Misrepresentation: Breach claims from relying parties
Contract Breach: Fee disputes and remedies
Regulatory Exposure: State licensing investigations
Privacy Risks: Improper data handling penalties
Recordkeeping Failures: Evidence gaps in disputes
