What a Business Accommodation Policy Covers

A Business Accommodation Policy documents an employer's procedures for receiving, evaluating, and implementing requests for reasonable workplace accommodations. It explains who may request accommodations, how to submit a request, the interactive process steps, required documentation, confidentiality protections, and timelines for decisions and implementation. The policy aligns internal practice with federal obligations (for example, Title I of the Americans with Disabilities Act, 42 U.S.C. §12111 et seq.) while providing consistent operational guidance for managers, HR, and employees.

Why a Clear Accommodation Policy Matters

A written policy supports legal compliance, reduces inconsistent decisions, protects employee privacy, and reduces operational disputes. It creates predictable steps for requests and responses, documents the interactive process, and helps employers assess undue hardship while preserving productivity and workplace safety.

Why a Clear Accommodation Policy Matters

Which People and Teams Use This Policy

The policy is used by employees requesting accommodations, supervisors who receive requests, HR staff who manage evaluations, and legal or benefits teams advising on compliance.

  • Employees requesting accommodations for disability, religious practice, or lactation support.
  • Supervisors and managers responsible for operational decisions and documenting requests.
  • Human Resources teams administering assessments, documentation, and recordkeeping.

Consistent use across these groups helps protect rights, preserve confidentiality, and speed appropriate workplace adjustments.

Core Sections to Include in Your Policy

A professional Business Accommodation Policy should be concise, actionable, and organized so each request follows the same steps from intake through implementation and appeals.

Scope

Define covered persons, protected characteristics (disability, religion, pregnancy), and which roles or facilities the policy applies to, including remote and hybrid workers.

Request Process

Explain how to submit requests (written form, email, HR portal), whom to notify, and whether an electronic signature or digital submission is acceptable under ESIGN (15 U.S.C. ch. 96) and applicable state law.

Interactive Process

Outline the employer-employee dialogue steps: assessing limitations, exploring effective accommodations, proposing alternatives, and documenting agreed actions and timelines.

Documentation

List acceptable medical or third-party documentation, privacy protections for health information, and whether a healthcare provider verification is required under HIPAA-safe practices.

Decision and Timing

State target response times, who makes accommodation decisions, methods for implementation, and criteria for denial such as undue hardship or direct threat.

Confidentiality

Describe storage, limited access to medical records, retention timelines, and how information is shared on a need-to-know basis to comply with privacy obligations.

Step-by-Step: How an Accommodation Request Is Processed

A standard workflow lets HR and managers track progress and meet internal response goals while preserving consistency and documentation.

  • 01
Submit Request: Employee files request with HR or submits the standardized form.
  • 02
Interactive Meeting: HR and supervisor meet with employee to discuss limitations and options.
  • 03
Assessment: Evaluate feasibility, request documentation if needed, and consult experts.
  • 04
Implement Decision: Document outcome, implement reasonable accommodation, or communicate denial with reasons.

Typical Digital Workflow Settings for Online Requests

Configure your intake and approval workflow to capture required fields, route to decision-makers, and retain a secure audit trail.

Field Configuration
Intake Form Required fields, attachments allowed, conditional fields for medical documentation
Routing Auto-route to HR and hiring manager with escalation rules
Authentication Email link or single sign-on for internal users
Audit Trail Record timestamps, user IDs, and signed confirmations

Digital Tools and File Formats to Support the Policy

Use platforms that support secure uploads, audit logs, and acceptable file formats for records management.

  • Formats Supported: PDF, DOCX, JPG
  • Key Integrations: HRIS and cloud storage
  • Authentication Options: Email, SSO, SMS codes

Ensure chosen tools meet your security, retention, and privacy requirements and integrate with HR systems for centralized recordkeeping.

Where to Submit or File an Accommodation Request

Make submission channels clear so employees know where to send requests and managers know where to look for them.

  • HR Portal: Primary digital intake for confidentiality
  • Email to HR: Use designated HR inbox and subject line
  • Supervisor Referral: Supervisor records request and forwards to HR
  • Paper Form: Accept when digital access is limited

Suggested Timelines and Response Expectations

Timelines should balance prompt responses with reasonable time to evaluate documentation and operational impact.

Initial Acknowledgment:

Acknowledge receipt within 3 business days

Interactive Meeting Target:

Hold meeting within 10–15 business days of request

Documentation Request Window:

Allow 15–30 days for supplementary documentation

Decision Timeline:

Provide a written decision within 30 business days

Implementation Period:

Implement accommodation within 7–30 days as feasible

Common Mistakes to Avoid When Preparing Requests

  • Submitting vague requests without explaining specific limitations and functional needs, causing delays in evaluating suitable accommodations.
  • Failing to follow the interactive process by not engaging the employee, not documenting conversations, or making unilateral decisions.
  • Requesting excessive medical details beyond functional limitations, risking privacy violations and noncompliance with HIPAA safeguards.
  • Missing retention and confidentiality steps for medical records, which can lead to unauthorized disclosure and legal exposure.

Potential Risks and Consequences of Errors

EEOC Charge: Discrimination complaint filed
Litigation Exposure: Monetary damages and fees
Regulatory Penalties: Administrative fines possible
Reputational Harm: Employee trust erosion
Operational Disruption: Lost productivity and churn
Privacy Violations: HIPAA or state data fines
