What the Business Advice and Suitability Form Is

The Business Advice and Suitability Form is a structured questionnaire used to document a business client's circumstances, objectives, risk tolerance, and the adviser’s recommendations on suitability. It collects identification, corporate structure, financial metrics, and scope of requested advice so the adviser can assess whether proposed services or products fit the client's needs. The form creates a written record that supports regulatory compliance, client onboarding, and later reviews. It is typically used by professional advisers, consultants, and firms that must demonstrate how advice was matched to a client's profile.

Why the Form Matters for Compliance and Decision Quality

Using a formal Business Advice and Suitability Form documents the adviser’s analysis and helps meet regulatory expectations for due diligence, recordkeeping, and conflict assessment. It reduces misunderstanding between parties and provides evidence that recommendations were considered against the client’s stated objectives and constraints.

Why the Form Matters for Compliance and Decision Quality

Who Typically Completes This Form and Who Signs It

The final signed form typically requires an authorized representative from the client and the adviser to validate accuracy and consent.

  • Adviser teams and consultants: prepare the form to record analysis and proposed actions, ensuring an audit trail for supervision.
  • Business owners and authorized officers: provide factual inputs (financials, ownership, objectives) and sign to acknowledge suitability findings.
  • Compliance and legal staff: review completed forms for recordkeeping, regulatory reporting, and dispute defense.

Core Sections to Include in a Professional Form

A robust Business Advice and Suitability Form combines client identification, financial profile, stated objectives, risk tolerance, proposed recommendations, and disclaimers or limits of advice. Each section should be clear, dated, and structured to support later review or audit.

Common Mistakes to Avoid

  • Incomplete financials: missing or estimated figures reduce the adviser’s ability to assess capacity and may invalidate suitability conclusions.
  • Unsigned pages: failing to capture dated signatures from authorized representatives undermines enforceability and complicates audits.
  • Vague recommendations: unspecified action items or absent rationale make it difficult to show the link between client facts and adviser choice.
  • Wrong signer authority: having a non-authorized person sign can require re-execution and may expose the firm to liability.

Consequences of Incorrect or Missing Information

Regulatory Exposure: Fines or enforcement action
Contract Disputes: Invalidated agreements or rescission
Tax Impact: Withholding or reporting errors
Reputational Harm: Client trust erosion
Operational Delay: Repeated requests slow processes
Liability Claims: Potential malpractice or breach suits
