What a Business Concessions Agreement Is and when it applies

A Business Concessions Agreement is a contract that grants a concessionaire the right to operate a specific business or service on property owned or managed by another party. Typical scenarios include food, retail, parking, and service concessions at airports, stadiums, malls, transit hubs, and event venues. The agreement defines the parties, scope of permitted activities, term and renewal mechanics, financial arrangements such as rent or revenue share, operational standards, insurance and indemnity obligations, permit and compliance responsibilities, and termination rights.

Why this agreement matters for operators and property owners

A clear Business Concessions Agreement allocates operational risk, secures predictable revenue or rent, ensures public-safety and regulatory compliance, and creates a framework for managing onsite services. Well‑drafted terms minimize disputes over hours, permits, maintenance, and revenue reporting while protecting both parties' commercial interests.

Why this agreement matters for operators and property owners

Who typically completes or signs a Business Concessions Agreement

The agreement is completed by parties who will operate, manage, or authorize concession activity and by those responsible for legal and financial oversight.

  • Venue Owner or Manager — Facility owners, airport authorities, or mall operators who grant space and set operational rules.
  • Concessionaire / Operator — Businesses or vendors that will run retail, food, parking, or service operations on site.
  • Corporate Legal or Procurement — Counsel or procurement staff who negotiate financial, indemnity, and compliance terms.

Each signer should have authority to bind their organization; include delegated signers only if authorized in writing and confirmed by corporate resolution or POA where required.

Core sections to include in a professional agreement
