What the Business DAF Agreement Packet Covers

The Business DAF Agreement Packet is a consolidated set of documents a business uses to open and manage a donor-advised fund (DAF) with a sponsoring public charity. It typically contains the fund agreement, corporate or board resolution authorizing the contribution, donor identification and tax forms, investment direction, distribution and grant recommendation procedures, and signature blocks for authorized signers. The packet records roles and responsibilities between the business, the donor-advisor, any custodial broker, and the sponsor so contributions, recommendations, and distributions are governed consistently and documented for tax substantiation.

Why a Complete Packet Matters for Tax and Governance

A complete Business DAF Agreement Packet documents authorization, substantiates charitable contributions for IRS purposes, and establishes operational rules for grant recommendations and investment handling.

Why a Complete Packet Matters for Tax and Governance

Who Typically Prepares and Signs This Packet

Businesses, their legal or finance teams, sponsoring charities, and broker-dealers commonly prepare or review the packet before fund funding.

  • Corporate finance teams and treasury: Prepare corporate resolutions and confirm internal authorization, ensuring the board or authorized officer approves the DAF contribution.
  • Legal counsel and outside counsel: Review agreement language for restriction, private benefit risk, and governing state law applicability.
  • Sponsoring public charities and custodial brokers: Accept the fund, verify donor identity, and set up investment and distribution processes.

Final signatures normally include an authorized company officer, the donor-advisor (if different), and the sponsoring charity representative to complete the packet.

Step-by-Step: Completing the Packet

Follow these core steps to prepare and submit a Business DAF Agreement Packet with minimal friction.

  • 01
Collect Documents: Assemble corporate resolution, EIN, and authorized signer ID copies.
  • 02
Complete Forms: Fill donor, contribution, and investment fields in MM/DD/YYYY and full name format.
  • 03
Attach Transfers: Provide broker transfer instructions or wire details for the sponsoring charity.
  • 04
Sign and Submit: Obtain required signatures and send to the sponsoring charity or custodian.

Where to Send the Completed Packet

Different recipients and routing steps depend on whether the donor is an individual, corporate entity, or working through a broker-custodian.

  • Sponsoring Charity: Send the packet and supporting docs to the sponsor's DAF intake team for account setup.
  • Broker-Dealer: If transferring securities, forward transfer instructions to the broker and copy the sponsor.
  • Internal Records: Retain a signed copy in the corporate records and finance system.
  • Tax Preparer: Provide the packet to tax counsel or preparer for donation substantiation guidance.

Digital Submission and System Requirements

Use a secure e-signature platform and standard document formats to ensure acceptance and archival integrity.

  • Accepted Formats: PDF and DOCX are commonly accepted by sponsors and custodians
  • Integrations: CRM or document storage integrations streamline routing and retention
  • Authentication: Use at least email plus one additional verification for business signers

Confirm the sponsoring charity's preferred upload method and any required backup attachments before final submission to avoid processing delays.

Practical Tips for Accurate and Efficient Completion

Apply consistent formatting, verify signer authority, and use templates to reduce errors and processing time.

Verify Legal Names
Confirm the business name and EIN against IRS records and corporate filings. Small discrepancies between documents commonly cause sponsor intake delays and additional verification requests.
Use Clear Transfer Routing
Provide precise wire/DTC instructions and confirm broker details in advance. Ambiguous transfer instructions commonly cause settlement delays and operational exceptions.
Document Corporate Authority
Attach a board resolution or officers' certificate naming authorized signers. Sponsors often require explicit evidence of corporate authorization before accepting large contributions.
Retain Signed Copies
Keep executed packets in a secure archive for the recommended retention period to support audits, donor substantiation, and compliance reviews.

Key Dates and Deadlines to Watch

Certain dates affect tax eligibility, reporting, and internal accounting — confirm them early in the process.

Contribution Date:

Must be completed by 12/31 to qualify for that tax year

Tax Return Deadline:

Individual and corporate returns: April 15 filing deadline (extensions may apply)

Acknowledgment Receipt:

Sponsor should issue donation acknowledgment per IRS substantiation rules

Broker Transfer Timing:

Allow extra settlement days for securities transfers to avoid missing year-end funding

Internal Approval Cycle:

Factor in board or signatory scheduling to meet tax-year contribution intentions

Common Errors and Risks to Avoid

Incorrect Tax Reporting: Penalties under IRC §6721
Missing Authorization: Contribution acceptance may be delayed or rejected
Mismatched EIN: Can trigger backup withholding
Improper Restrictions: May create private benefit concerns
Late Transfers: May miss intended tax year
Inadequate Records: Limits ability to substantiate deductions
