What the Business LBP Addendum Is and when it applies

The Business LBP Addendum documents lead-based paint disclosures or related acknowledgements used in property transactions where a commercial or business interest is involved. It clarifies whether the property has known lead-based paint hazards, references inspection reports or previous remediation, and records allocations of responsibility for any required disclosures, inspections, or abatements. Although federal lead disclosure rules focus on residential properties built before 1978, sellers and landlords for business or mixed-use properties often use a Business LBP Addendum to record voluntary disclosures, risk assessments, or contractual indemnities, creating a clear, signed record for future liability management.

Why including a Business LBP Addendum matters for risk and clarity

A clear addendum reduces ambiguity about known or suspected lead hazards, documents shared inspection results, and allocates responsibility for remediation and notice obligations. Properly completed, it helps preserve contractual rights, supports regulatory compliance where applicable, and provides evidence of disclosure and consent if disputes arise.
