What the Business Moonlight Document Is

The Business Moonlight Document is a formal disclosure and approval form used by employers and employees to document outside employment, consulting, or business activities. It records the scope of secondary work, potential conflicts of interest, confidentiality and IP allocations, expected hours, and compensation arrangements. The document can operate as an internal policy acknowledgment or a binding agreement between the employer and employee when executed properly. Electronic execution is generally enforceable under federal and state e-signature laws such as the ESIGN Act and applicable state UETA or ESRA provisions.

Why maintaining a Moonlighting Agreement matters

A clear document reduces conflicts, protects confidential information and intellectual property, sets expectations for work hours and performance, and provides a recorded approval trail for HR and legal teams. Proper documentation helps employers enforce policies and helps employees understand permitted activities and restrictions.
