Terrorism Coverage Election

The Insured selects one of the following options regarding coverage for loss arising out of an act of terrorism. Check exactly one box and complete associated fields where indicated.

Accept terrorism coverage as an endorsement to the policy. Coverage shall be subject to the terms, limits, conditions and exclusions of the policy and the terrorism endorsement.

Decline terrorism coverage. By declining, the Insured acknowledges that no coverage will apply for losses arising out of an act of terrorism as defined below.

Definitions

"Act of Terrorism" means an act, including but not limited to the use of force or violence or the threat thereof, by any person or group of persons acting alone or on behalf of or in connection with any organization, committed for political, religious, ideological or similar purposes, including the intention to influence any government or to put the public or a section of the public in fear. Coverage for an act of terrorism is limited to losses that are the direct physical loss or damage resulting from such an act, subject to the terms and limitations of the policy and endorsement.

"Certified Act" means an act of terrorism certified as such pursuant to applicable statutory procedures under which specified limitations or sublimits may apply to recovery. The application of any certification process, certification date or other procedural mechanism shall be governed by the terms of the policy, endorsement and applicable law.

Exclusions

Unless otherwise expressly endorsed, this endorsement excludes coverage for loss or damage directly or indirectly caused by or resulting from: (a) war, invasion, act of foreign enemy, hostilities (whether war declared or not), civil war, rebellion, revolution, insurrection or military usurpation; (b) nuclear reaction, radiation, or radioactive contamination; (c) willful acts, fraudulent acts, or criminal acts by the insured; (d) loss resulting from the release, dispersal, or escape of chemical, biological, radiological or similar agents; (e) loss of electronic data not resulting in direct physical loss of covered property; and (f) any consequential or indirect loss not specifically covered by the policy.

The Insured expressly acknowledges that certain exclusions may limit recovery for particular types of terrorism-related loss even where terrorism coverage is elected.

Insured acknowledges receipt and review of the exclusions set forth above.

What the Business Owner's Policy Terrorism Form Is

The Business Owner's Policy Terrorism Form documents whether and how terrorism coverage applies to a commercial Business Owner's Policy (BOP). It typically appears as an endorsement or election that modifies the underlying policy limits, exclusions, and premium. The form records the insured party, covered locations, selected limits and deductibles, and any TRIA-related disclosures or opt-outs required by the insurer. Insurers use it to document coverage scope for underwriting, billing, and claims handling while creating a clear record of the insured's choice regarding terrorism exposure.

Why this Form Matters for Coverage Clarity

Completing the terrorism form clarifies whether terrorism losses are covered, sets limits and deductibles, and establishes premium and claims procedures. It reduces ambiguity at claim time and supports compliance with insurer and regulatory reporting requirements.

Why this Form Matters for Coverage Clarity

Who typically completes the form

Agents, brokers, and insured representatives complete the form to document coverage elections and underwriting data.

  • Insurance agent or broker — prepares and submits endorsement with client details and underwriting notes.
  • Business owner or authorized officer — reviews coverage choices, signs to accept or decline terrorism coverage.
  • Risk manager or CFO — confirms limits and deductible levels for corporate policy portfolios.

The completed form acts as the official record of the insured's decision about terrorism coverage and premium adjustments.

Common mistakes to avoid

  • Submitting mismatched insured names or policy numbers that delay processing and create underwriting questions.
  • Leaving coverage selection ambiguous or unchecked, resulting in unintended exclusions at claim time.
  • Failing to retain signed audit trails or notarizations, which complicates proof of consent for carriers.
  • Not confirming whether electronic signatures and remote notarization satisfy the insurer's acceptance policy.

Risks and consequences of incorrect completion

Coverage Gap: Claims may be denied
Premium Adjustment: Retroactive charges possible
Claim Delay: Underwriting questions slow payouts
Regulatory Exposure: Noncompliance with disclosures
Notarization Defect: Signature validity challenged
Recordkeeping Failure: Audit penalties or disputes

Practical tips for accurate and efficient completion

Implement consistent procedures and quality checks to reduce errors and speed endorsement acceptance.

Cross-check policy data
Verify the policy number, insured legal name, and location address against the declarations page before you begin; this prevents misrouting and underwriting delays and ensures the endorsement attaches to the correct policy record.
Document signer authority
Confirm that the signer has explicit authority to bind the entity and retain evidence of that authority in your file; this reduces the risk of later coverage challenges or disputes about consent.
Use a validated e-sign workflow
Match authentication strength (email, SMS OTP, or KBA) to insurer requirements, and capture a complete audit trail including IP, timestamp, and signed PDF for defensible records retention.
Archive signed packages
Store the endorsement, declarations, and supporting loss runs together in a secure CMS or insurer portal so claims and audits can reference a single consolidated package.
