What a Business SCA Letter Is and When It’s Used

A Business SCA Letter is a written certification used by a company to document compliance with Service Contract Act obligations, supplier compliance attestations, or similar contract-specific labor and benefit assurances. It typically identifies the contracting parties, effective dates, applicable wage determinations, and statements verifying that labor standards and fringe benefits are being provided or will be paid. Organizations use this letter to accompany bids, contract modifications, or audit responses where an explicit, signed business statement about SCA-related responsibilities is required under procurement rules.

Why a Clear Business SCA Letter Matters

Use a Business SCA Letter to provide a clear, auditable record of wage and benefit compliance or contractual assurances. It reduces misunderstandings during procurement reviews, supports audit responses, and documents who is responsible for meeting SCA-related obligations under a specific contract.

Why a Clear Business SCA Letter Matters

Who Typically Prepares and Receives This Letter

Typical users include contracting officers, prime contractors, subcontractors, and compliance officers preparing procurement submissions or audit responses.

  • Prime contractors submitting compliance attestations with bid or proposal packages.
  • Subcontractors confirming wage determinations and fringe benefit practices for contract line items.
  • Government contracting officers requesting written verification during award or audit processes.

Maintain clear signatory authority and supporting records so recipients can verify the statement quickly and electronically.

Essential elements to include in a professional Business SCA Letter

A professional Business SCA Letter should contain structured certification language, clear scope, signer authority, supporting exhibits, effective dates, and references to applicable wage determinations.

Certification Statement

A concise assertion that the company complies with applicable SCA wage and fringe benefit requirements for the named contract, including any qualifications or limitations to the certification being provided.

Scope

Specify contract numbers, line items, job classifications, and effective date range so reviewers can determine exactly which obligations the letter addresses without supplemental clarification.

Signer Details

Include printed name, title, contact information, and a statement confirming the signer is authorized to make the certification on behalf of the company, and reference a corporate resolution if available.

Supporting Exhibits

Attach payroll registers, fringe benefit calculations, wage determination citations, and any insurance or subcontractor agreements, with dates and page references, that substantiate the certification statements.

Retention Note

State where the signed letter and its backups will be retained, the retention period with legal basis, and the responsible records custodian for audit retrieval and contact.

Electronic Signature

If signed electronically, include the eSigning method, authentication level, and a note confirming the platform captures an immutable audit trail with timestamps and signer attribution.

Security and compliance considerations for e-signed SCA letters

Encryption in Transit: TLS 1.2 and 1.3 protocols
Encryption at Rest: AES-256 encryption at rest
Certifications: SOC 2 Type II, ISO 27001
HIPAA Support: BAA available upon request
21 CFR Part 11: Compliant for electronic records
Audit Trail: Detailed timestamps and IP logs

Potential consequences of inaccurate or incomplete letters

Contract Remedies: Withholding or termination
Financial Penalties: Fines or cost adjustments
Bid Disqualification: Loss of award eligibility
Audit Exposure: Document requests and penalties
Reputational Harm: Damaged contractor standing
Debarment Risk: Possible suspension

Common preparation errors to avoid

  • Failing to reference the correct wage determination leads to auditor questions and potential corrective pricing adjustments or withholding from invoices during contract performance.
  • Submitting the letter signed by someone without documented authority can invalidate the certification and prompt requests for a corporate resolution or re-execution.
  • Omitting supporting exhibits, such as payroll registers or fringe calculations, frequently causes delays while reviewers seek evidence to corroborate claimed compliance.
  • Using vague scope language may lead to differing interpretations about covered periods or personnel, increasing the likelihood of post-award disputes or formal audits.
