What the Business Services SS-4 Is

The Business Services SS-4 is the IRS Form SS-4 completed to request an Employer Identification Number (EIN) for a business entity. An EIN is a federal taxpayer identification number used to file employment taxes, open business bank accounts, apply for business licenses, and report information returns. The SS-4 records the legal name, trade name, responsible party, business structure, reason for applying, date business started, and contact details needed by the IRS to issue an EIN. The form is a federal filing; no state SS-4 substitute exists.

Why the SS-4 Matters for Your Business

An EIN enables payroll reporting, business tax filings, bank accounts, and vendor onboarding. It separates personal and business tax responsibilities and is often required before hiring, opening accounts, or filing information returns.

Why the SS-4 Matters for Your Business

Who Typically Completes the Business Services SS-4

Lead filers include business owners, authorized representatives, and third-party preparers who register an entity with the IRS.

  • Small business owners applying for tax accounts and bank accounts.
  • CPAs and tax preparers registering EINs for clients.
  • Registered agents or authorized third parties filing on behalf of entities.

After issuance, payroll administrators and accountants commonly use the EIN for tax reporting and information returns.

Apply before hiring employees, opening bank accounts, or filing information returns.

Immediate issuance:

Online applicants often receive EIN immediately upon successful completion.

Paper processing:

Mail or fax submissions may take several weeks depending on IRS workload.

Use for tax returns:

Obtain EIN before filing Forms 941, 940, or information returns that require a TIN.

International applicants:

International applicants use phone or post options; expect longer processing times.

Frequent errors to avoid when preparing the SS-4

  • Entering a DBA instead of the legal entity name, causing a mismatch with IRS records and bank requirements.
  • Listing the wrong responsible party or omitting the SSN/ITIN, which can delay or require amended submissions.
  • Selecting incorrect entity classification (for example, choosing corporation instead of LLC taxed as S corp).
  • Failing to attach or provide required third-party authorization when an agent files on behalf of the business.

Penalties and risks related to incorrect EIN use

Incorrect TIN: Backup withholding risk
Late reporting: Penalties under IRC §6721
Misclassification: Payroll tax reclassification
Identity mismatch: Bank account opening delays
Unauthorized filing: Potential agent liability
Intentional disregard: Higher fines per IRC §6721

Key components to complete on the Business Services SS-4

Each of these elements is essential for issuance and downstream tax reporting; fill them carefully and consistently with formation records.

Legal entity

The exact registered legal name as shown on formation documents; mismatches can prevent bank account opening and cause IRS correspondence requiring correction.

Trade name

A DBA or trade name, if used publicly. Entering this correctly ensures vendor payments and public records reference the business as intended.

Responsible party

Full name and SSN/ITIN of the individual with control over business funds; this attribution is required under IRS rules for identity and tax responsibility.

Entity type

Select the business structure (sole proprietor, partnership, corporation, LLC, estate, trust) because tax treatment and filings depend on this selection.

Reason for applying

Indicate why the EIN is requested (starting business, hiring employees, banking, compliance); the IRS uses this for processing priority and internal routing.

Start date and employees

Provide the business start date and estimated number of employees; these affect payroll tax schedules and employment tax obligations.
