What the Business TN Letter Is and when it’s used

A Business TN Letter is an employer-issued support letter used to document a temporary professional job offer under the TN nonimmigrant classification (USMCA/NAFTA). The letter describes the employer, job title, duties, duration, offered wage, and the applicant’s qualifying credentials. It accompanies the applicant’s documents at a U.S. port of entry, pre-flight inspection, or as part of a USCIS filing when seeking TN admission or an extension. Accurate, specific letters reduce the risk of secondary inspection, Requests for Evidence, or denial and should align with the profession’s regulatory requirements and licensure where applicable.

Why a clear Business TN Letter matters for admission

A well-prepared letter provides the primary evidence that the position and the applicant meet TN criteria, clarifies temporary intent, and streamlines inspection and adjudication.

Why a clear Business TN Letter matters for admission

Who typically prepares and relies on a Business TN Letter

Employers, HR teams, immigration counsel, and employees use the letter to document the job offer and eligibility for TN status.

  • Employers and HR: Prepare and sign the letter; provide job details and wage information for the applicant.
  • Employees or Applicants: Present the letter at the port of entry or include it with USCIS filings to prove eligibility.
  • Immigration Counsel: Review language, ensure compliance with profession-specific credentialing, and advise on supporting exhibits.

Keep an executed copy with personnel and immigration files and retain supporting credentials and licensing documentation per record retention rules.

Core elements to include in a professional Business TN Letter

Include clear, verifiable facts and avoid vague or boilerplate language; each element helps adjudicators match the role to an eligible TN profession.

Employer information

Provide the employer’s full legal name, mailing address, physical worksite, contact name, phone number, and company business description so adjudicators can verify the business and the position’s necessity.

Job title

State the exact job title and note any equivalent occupational classification used by the sponsoring company; avoid generic titles like 'consultant' without further detail linking duties to a qualifying TN profession.

Duties summary

Give a concise, itemized description of daily and project-level duties that demonstrates the role requires the specific professional qualifications listed in TN categories.

Duration and intent

Specify the anticipated start date, expected period of employment, and a clear statement that the position is temporary and that the employee will depart the U.S. when the assignment ends.

Qualifications

List the applicant’s required degree, licensure or certification, and how their credentials meet the TN occupational requirements; reference degree level and field explicitly.

Compensation and terms

State the offered salary or wage, payment frequency, and reporting relationship; include any benefits or pertinent employment conditions that clarify the bona fides of the offer.

Required factual items to include in the letter

Employer legal name: Full registered entity name
Worksite address: Street, city, state, ZIP
Job title: Exact title used at company
Start date: MM/DD/YYYY preferred
Duration estimate: Length of assignment
Salary details: Wage amount and pay frequency

Step-by-step: preparing and delivering the Business TN Letter

Follow a concise sequence from drafting to presentation so the employee can demonstrate eligibility confidently at inspection or during USCIS processing.

  • 01
Draft text: Write clear duties, duration, salary, and qualifications.
  • 02
Attach evidence: Include degree, transcripts, licensure, and resume.
  • 03
Employer signature: Have an authorized company representative sign the letter.
  • 04
Submit or present: Employee shows letter at port of entry or files with USCIS as needed.

Configuring an online workflow for the Business TN Letter

Set up a digital review and signature flow to ensure the letter has required fields, attachments, and a verified signer before delivery.

Field Configuration
Upload document PDF or DOCX accepted
Signature field Place for authorized signer
Attachments Add degree and license files
Authentication Email or SMS code

Typical routing and submission paths for the letter

Choose the route that matches the applicant’s process: immediate port presentation or USCIS filing for change/extension of status.

  • Employer creates: Drafts and signs the letter internally.
  • Employee receives: Collects letter and supporting exhibits.
  • Port presentation: Employee presents packet to CBP officer.
  • USCIS filing: Include letter in extension/change application packet.

Digital signing and file-format considerations

Use common document formats and signer authentication to preserve evidentiary weight and ensure compatibility with adjudicators.

  • Supported formats: PDF and DOCX preferred
  • Authentication: Email link or SMS code
  • Audit trail: Capture IP and timestamp

Retain signed PDFs with audit trails and attached credentials to support inspection or USCIS review; platforms that meet ESIGN/UETA preserve admissibility.

Timing and processing expectations for TN entry and extensions

Understand the difference between immediate port-of-entry admission and USCIS adjudication timelines and plan document delivery accordingly.

Port-of-entry presentation:

Immediate decision at inspection; processing varies by CBP workload

USCIS extension filing:

USCIS adjudication can take weeks to months depending on service center

Start date coordination:

Align job start with admission or approval date

Documentation readiness:

Have degree, license, resume, and employer letter ready at presentation

Renewal timing:

File extension well before expiration; TN is temporary and renewable

Common mistakes to avoid when preparing the letter

  • Using vague job descriptions that fail to link duties to a qualifying TN occupation leads to secondary inspection or denial.
  • Missing or inconsistent dates between the letter, offer, and supporting documents undermines the temporary intent requirement.
  • Unsigned or improperly authorized letters (no company officer signature or lacking title) are often rejected by CBP or USCIS.
  • Failing to attach degree documentation, transcripts, or professional licenses frequently triggers Requests for Evidence or denial.

Risks and consequences of incorrect or misleading letters

Admission denial: Possible refusal of TN entry
Removal risk: Deportation for misrepresentation
Bar on future entry: Potential inadmissibility
USCIS denial: Application rejection or RFEs
I-9 implications: Employment eligibility review
Reputational harm: Employer credibility impacted

Real-world scenarios where a Business TN Letter is central

These scenarios show typical employer letters and how evidence supports TN classification.

Consultant assignment

A U.S. tech firm offers a software engineer a 12-month contract to work on a specific project

  • The duties list includes specialized programming tasks tied to the applicant’s degree
  • The letter, plus a degree transcript and detailed resume, enabled inspection officers to grant admission without secondary inspection and the professional began work immediately.

University appointment

A foreign professor is offered a visiting faculty position for two academic years

  • The letter states rank, course duties, and research obligations
  • Combined with the professor’s Ph.D. credentials and an institutional appointment letter, the packet supported approval at a U.S. port of entry.
