What the Business Use AUP Document Is

A Business Use Acceptable Use Policy (AUP) defines permitted and prohibited uses of company IT resources, data, and services for employees, contractors, and third parties. It establishes expectations for behavior, ownership of corporate accounts, handling of sensitive information, remote access, and consequences for violations. The document typically covers monitoring, privacy limits, incident reporting, and enforcement procedures so that personnel understand obligations and the employer can demonstrate consistent policy application across systems and locations.

Why a Clear AUP Matters for Your Organization

A concise Business Use AUP reduces legal risk, clarifies acceptable behavior, and supports compliance programs by documenting controls and response processes. It helps protect sensitive data, supports regulatory obligations, and provides objective grounds for disciplinary action when rules are violated.

Why a Clear AUP Matters for Your Organization

Who Prepares, Reviews, and Signs the AUP

Different teams play distinct roles in creating and enforcing an AUP; coordination ensures coverage across legal, IT, and HR.

  • IT and information security teams: draft technical controls, access rules, and monitoring procedures.
  • Legal and compliance: review policy language, regulatory requirements, and retention obligations.
  • Human resources: integrate acknowledgement, training, and disciplinary procedures into employee processes.

Use a multi-stakeholder review cycle and designate an owner to manage updates and distribution.

Core Sections to Include in a Business Use AUP

An effective AUP is structured, legally precise, and operationally actionable so staff can comply and administrators can enforce rules consistently.

Scope

Define covered users, devices, accounts, and systems. Clarify whether contractors and BYOD devices are included and state any exclusions or special classes of users.

Permitted Use

Describe acceptable activities and business purposes with examples. Explicitly list approved services and any limited personal use permitted under supervision.

Prohibited Use

List forbidden activities—data exfiltration, unauthorized software, high-risk file sharing, illegal activities, and attempts to bypass security controls.

Data Handling

Classify data types, handling requirements, encryption rules, storage locations, and rules for transmitting sensitive information both internally and externally.

Enforcement

Specify investigative steps, disciplinary measures, escalation paths, and conditions for suspension or termination of access tied to violations.

Incident Reporting

Provide clear reporting channels, timelines for escalation, and preservation steps for forensic evidence following suspected breaches or misuse.

Step-by-Step: Issuing and Recording AUP Acknowledgement

Follow a simple sequence to publish, distribute, collect acknowledgements, and retain signed records for compliance and audits.

  • 01
Draft and Approve: Legal and IT finalize policy language and sign-off.
  • 02
Publish: Publish internally and notify covered users of availability.
  • 03
Collect Signatures: Distribute for signature and record acknowledgements.
  • 04
Archive and Review: Store signed records and schedule annual review.

How to Configure an Online Acknowledgement Workflow

Set up a repeatable e-sign and tracking workflow so acknowledgements are collected consistently and records are retained securely.

Field Configuration
Signature Method Email link, SMS code, or RON where appropriate
Authentication Email verification, optional SMS OTP, or SSO
Retention Export signed PDF/A with audit trail
Integrations Connect to HRIS, SSO, and document storage systems

Technical and Platform Requirements for eAcknowledgement

Choose systems that support legal e-sign standards, audit trails, and long-term access to signed records.

  • File Formats: PDF, DOCX supported
  • Authentication: Email, SMS, or SSO
  • Integrations: HRIS, Salesforce, NetSuite

Ensure the platform encryption and retention features meet legal and internal audit requirements before roll-out.

Where to Send and Store the Completed AUP

Define destinations and owners for signed AUPs so retrieval for audits, investigations, and HR actions is straightforward.

  • HR Records: Store employee acknowledgements in HRIS or personnel files
  • Security Archive: Retain incident-linked copies in a secure repository
  • Legal Holds: Move affected records to legal hold when required
  • Central Document Store: Maintain master policy document with version history

Common Preparation Mistakes to Avoid

  • Using vague language that leaves enforcement to interpretation, increasing inconsistency and legal exposure.
  • Failing to define the user population clearly so contractors or third parties are mistakenly excluded from coverage.
  • Omitting procedures for reporting and preserving evidence, which undermines incident investigations and forensic analysis.
  • Not integrating acknowledgement with HR or onboarding systems, causing incomplete records and audit gaps.

Required Security and Compliance Information to Include

Encryption in Transit: TLS 1.2/1.3
Encryption at Rest: AES-256
Audit Trail: Detailed timestamps and IPs
HIPAA BAA: State whether BAA required
21 CFR Part 11: Note applicability for FDA-regulated records
Certifications: SOC 2 Type II, ISO 27001

Penalties and Risks if the AUP Is Incorrect or Missing

Regulatory Fines: Fines and enforcement actions
Data Breach Liability: Increased legal exposure
Contract Breach: Counterparties may assert violations
Employment Disputes: Greater wrongful termination risk
Operational Disruption: Confusion during incidents
Reputational Harm: Customer and partner loss

Practical Tips for Accurate and Efficient AUP Completion

Follow these practical recommendations to improve clarity, adoption, and enforceability when issuing a Business Use AUP.

Keep Language Plain and Specific
Use clear terms and defined glossary entries for key concepts. Avoid broad or ambiguous phrases that hinder consistent enforcement or create legal uncertainty.
Integrate with Onboarding Systems
Automate distribution and acknowledgement capture through HRIS or e-sign platforms to avoid manual tracking and incomplete records.
Train and Reinforce Regularly
Supplement the AUP with role-based training and periodic reminders; documented training increases compliance and supports disciplinary decisions.
Maintain Version Control
Record version number, effective date, and approval history so auditors and investigators can reconcile actions to the correct policy text.

Who Typically Signs the Business Use AUP

Chief Information Security Officer (CISO)

The CISO or equivalent often owns policy content and approval. They coordinate security controls, define enforcement measures, and work with legal and HR on incident response and disciplinary protocols.

HR Manager

HR manages distribution, acknowledgement tracking, and integration with onboarding and performance processes. HR enforces training requirements and documents acknowledgements for personnel files.
