What a Buyer Broker Compensation Agreement Is

A Buyer Broker Compensation Agreement is a written contract between a buyer and a real estate broker that sets the broker's compensation, scope of services, and the period of representation. It clarifies whether the broker will be paid by the buyer, the seller, or through a cooperative compensation arrangement, and it documents duties such as property search, negotiation, and transaction coordination. The agreement also specifies term dates, exclusivity (if any), and how disputes will be resolved. Having a clear, signed compensation agreement reduces misunderstandings and provides evidence of the parties' expectations during a real estate transaction.

Why this Agreement Matters for Buyers and Brokers

The Buyer Broker Compensation Agreement establishes mutual expectations about pay and services, reduces conflict over commissions, and creates a documented basis for enforcing payment terms. It helps buyers understand the broker's responsibilities and gives brokers a clearer claim to compensation when they produce a ready, willing, and able buyer.

Why this Agreement Matters for Buyers and Brokers

Who Typically Uses a Buyer Broker Compensation Agreement

This agreement is most commonly used in residential and commercial real estate transactions where brokers represent buyer interests.

  • Individual homebuyers working with a licensed buyer's agent to secure purchase representation and search assistance.
  • Real estate brokers and licensed agents documenting compensation arrangements and listing cooperation expectations.
  • Real estate brokerages that require written agreements for compliance, internal tracking, and commission allocation.

Use a written agreement whenever a broker is retained to ensure legal clarity and to support any later commission claim.

Practical Tips for Accurate and Efficient Completion

Follow these practices to reduce disputes and speed processing across the transaction lifecycle.

Use Clear Compensation Language
Specify amount, percentage, or calculation method, name the payer, and state when commission is earned and payable to avoid subjective interpretation later.
Keep Party Information Consistent
Match names and addresses to government ID and closing documents; inconsistent names create title, escrow, and tax reporting problems.
Record Dates Precisely
Use MM/DD/YYYY for effective and expiration dates; ambiguous date language can void exclusivity or entitlement to commission.
Retain Executed Copies Securely
Store final signed PDFs with audit trails and backups; maintain accessible records to meet retention and audit requirements.
