What the Buyer Representation Tour Agreement Is and When It’s Used

A Buyer Representation Tour Agreement is a written contract between a prospective buyer and a real estate agent or brokerage that documents the agent’s role during property showings and tours. It sets expectations for representation, tour scheduling, commission arrangements, exclusive or non‑exclusive buyer agency terms, and the agreement’s effective and expiration dates. The form helps prevent misunderstandings about agency duties, confidentiality, and allowed communications while the buyer visits properties. It is commonly used before in‑person or virtual tours begin and can be signed electronically when permitted by state law.

Why a Clear Tour Agreement Matters for Buyers and Agents

Documenting buyer representation protects both parties by clarifying agency duties, compensation expectations, scheduling rules, and confidentiality obligations. It reduces dispute risk and creates a clear record of consent to representation and tour logistics while preserving options for electronic signatures under the ESIGN Act and applicable state law.

Why a Clear Tour Agreement Matters for Buyers and Agents

Who Typically Completes a Buyer Representation Tour Agreement

Real estate agents, brokerages, and prospective buyers complete this agreement before tours to record representation, access permissions, and payment terms.

  • Buyers and co‑buyers entering active property search phases who want the agent’s exclusive or non‑exclusive touring services.
  • Licensed real estate agents and broker associates representing buyers during showings and collecting agency consent.
  • Brokerage compliance teams using standardized forms to ensure disclosures and commission terms are clearly documented.

Use the form early in the relationship to capture consent, avoid later commission disputes, and enable lawful electronic signing where allowed.

Essential Clauses to Include in a Professional Tour Agreement

A complete Buyer Representation Tour Agreement organizes agency scope, commission terms, tour logistics, confidentiality, term length, and termination rights so both parties understand obligations and remedies.

Agency Scope

Describe whether the agent acts as the buyer’s exclusive agent, limited agent, or transaction broker; list duties such as property research, arranging tours, and negotiation support in plain language.

Compensation

State commission arrangement, who pays commission, any buyer fee, and circumstances that trigger payment — include reimbursement for canceled tours or third‑party vendor fees if applicable.

Tour Logistics

Specify scheduling rules, notice requirements, who may attend tours, parking/entry procedures, and expectations for virtual vs in‑person showings.

Term and Renewal

Define the agreement’s effective date, expiration date, automatic renewal rules if any, and the process for extension or written termination by either party.

Confidentiality

Include nondisclosure language protecting sensitive buyer information and any limits on sharing property pursuit strategies with third parties.

Dispute Resolution

Specify governing law, arbitration or mediation clauses if desired, and the chosen state for adjudication to reduce future procedural uncertainty.

  • Using inconsistent party names or misspelled legal names that can hinder enforceability and cause title or payment issues.

Potential Risks and Legal Consequences

Commission Disputes: May result in arbitration or litigation.
Voidable Terms: Ambiguous clauses can be unenforceable.
