WHEREAS

WHEREAS, Camp Operator operates and manages the designated campground and related facilities and offers temporary campsite reservation and ancillary services to registered campers; and

WHEREAS, Camper seeks to reserve a campsite and to obtain services described herein subject to the terms, rules, and fees set forth in this Agreement;

NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows.

Scope of Services

The following describes the services to be provided by Camp Operator to Camper. Services include reservation of the specified campsite, access to campground facilities during posted hours, and any ancillary services expressly listed below. Services do not include any illegal activities, off-site transportation, or professional guides unless separately contracted.

Payment Terms

Camper shall pay Camp Operator the fees set forth below in consideration for the reservation and services. All fees are due in accordance with the schedule specified. Failure to pay fees when due is a material breach permitting suspension of services and denial of campground access.

Term and Termination

This Agreement commences on Start Date: and terminates on End Date: , unless earlier terminated pursuant to this section.

Either party may terminate this Agreement for convenience by providing written notice to the other party at least days prior to the intended termination date. Camp Operator may immediately terminate or suspend services for nonpayment or conduct that endangers persons or property. Cancellation by Camper may be subject to forfeiture of deposit in accordance with the cancellation policy set forth below.

Rules, Waiver of Liability and Assumption of Risk

Camper agrees to comply with all posted campground rules and any reasonable directions of Camp Operator staff. Camper acknowledges that camping and related outdoor activities involve inherent risks including but not limited to terrain, wildlife, weather, fire, and the actions of other persons. Camper voluntarily assumes all such risks.

Camper hereby releases, waives, and discharges Camp Operator, its owners, employees, and agents from any and all liability, claims, or demands for personal injury, property damage, or wrongful death arising out of or related to Camper's participation in camping activities, except to the extent caused by Camp Operator's gross negligence or willful misconduct.

Confidentiality

Each party shall maintain the confidentiality of non-public personal information and business information disclosed by the other party in connection with this Agreement. This obligation survives termination of this Agreement for a period of two years.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to conflict of law principles. Venue for any dispute arising under this Agreement shall lie exclusively in the state or federal courts located in the same jurisdiction.

Entire Agreement

This Agreement, including any attachments or written confirmations executed by the parties, constitutes the entire agreement between Camp Operator and Camper regarding the subject matter herein and supersedes all prior discussions, negotiations, and agreements. Any amendment must be in writing and signed by both parties.
