CAR RENTAL AGREEMENT

This Car Rental Agreement ("Agreement") is made and entered into on Day: Month: Year: by and between Owner Name: with principal address: ("Owner"), and Renter Name: with principal address: ("Renter").

RECITALS

WHEREAS, Owner is the lawful registered owner of the motor vehicle described herein and is entitled to lease the vehicle to others; and

WHEREAS, Renter desires to rent said motor vehicle from Owner for the limited term and purposes set forth in this Agreement and Owner is willing to rent the vehicle to Renter upon the terms and conditions contained herein.

NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, the parties agree as follows:

Owner hereby rents to Renter the following motor vehicle (the "Vehicle"):

3. RENTAL CHARGES; PAYMENT

Renter shall pay Owner a rental rate of per . A security deposit of is due at commencement. All payments are due in accordance with Owner's invoice terms and are payable in United States dollars.

Late payments shall accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, and Renter is responsible for all collection and legal costs incurred by Owner in enforcing payment obligations.

4. USE, RESTRICTIONS, AND PERMITTED DRIVERS

Renter shall use the Vehicle only for lawful purposes and shall not permit use by any person other than an authorized driver listed below. Renter certifies that each authorized driver holds a valid driver's license and is experienced in operating similar vehicles.

Prohibited uses include, without limitation: racing, off-road use, transporting hazardous materials, operation by any person under the influence of alcohol or drugs, use for hire or commercial transportation unless expressly permitted in writing, and transporting more passengers than the Vehicle is legally designed to carry.

5. INSURANCE, LOSS, DAMAGE, AND LIABILITY

Renter shall maintain, at Renter's expense, insurance coverage meeting the minimum liability and physical damage requirements set forth below. Renter shall provide proof of insurance prior to taking possession and shall list Owner as an additional insured and loss payee to the extent applicable.

Renter is responsible for all loss or damage to the Vehicle not caused solely by Owner's negligence, including but not limited to theft, collision, vandalism and weather-related damage, subject to the applicable deductible. Renter shall be liable for diminution in value resulting from damage beyond normal wear and tear.

6. MAINTENANCE AND REPAIRS

Renter shall be responsible for routine maintenance and for immediately notifying Owner of any mechanical issues. Renter shall not perform repairs exceeding without Owner's prior written authorization, except where immediate action is required to prevent further damage or ensure safety.

7. ACCIDENTS, THEFT, AND REPORTING

Renter shall notify local law enforcement and Owner immediately upon any accident, theft, loss, or damage to the Vehicle and shall provide Owner with a written incident report within 24 hours. Renter shall cooperate fully with Owner and insurers in any investigation or claim, and shall not admit fault or liability to third parties.

8. FUEL, MILEAGE AND RETURN CONDITION

Fuel policy: Renter will return the Vehicle with the same fuel level as at commencement. If returned with less fuel, Owner may charge a refueling fee plus fuel cost. Mileage allowance (if any): .

The Vehicle shall be returned in substantially the same condition as when delivered, reasonable wear and tear excepted. Owner may assess charges for excessive cleaning, interior damage, missing keys, or excessive wear.

9. REPRESENTATIONS AND WARRANTIES

Each party represents and warrants that it has the authority to enter into this Agreement and that execution by the signing representative will bind such party. Renter represents that the information provided to Owner is true, complete, and not misleading.

10. INDEMNIFICATION; WAIVER OF SUBROGATION

To the fullest extent permitted by law, Renter shall indemnify, defend and hold Owner harmless from and against any loss, liability, damage, claim or expense (including reasonable attorneys' fees) arising from Renter's use of the Vehicle, except to the extent caused by Owner's gross negligence or willful misconduct. Renter shall not permit its insurer to seek subrogation against Owner for any claim arising out of Renter's use of the Vehicle.

11. TERMINATION

Owner may terminate this Agreement immediately upon breach by Renter, including failure to pay any amounts when due or permitted use violations. Upon termination, Renter shall promptly return the Vehicle and remain liable for rental charges, loss of use, and damages.

12. NOTICES

Any notice required or permitted under this Agreement shall be given in writing and delivered to the addresses set forth below or to such other address as a party designates in writing.

13. AMENDMENTS; WAIVER; COUNTERPARTS

This Agreement may be amended only by a written instrument signed by both parties. No waiver of any provision will be effective unless in writing and signed by the waiving party. This Agreement may be executed in counterparts, each of which shall be deemed an original.

14. GOVERNING LAW; VENUE

This Agreement shall be governed by and construed in accordance with the laws of the state indicated by the parties below. The parties submit to the exclusive jurisdiction of the courts located in the county and state where the Vehicle is principally located at commencement of the rental term.

15. ENTIRE AGREEMENT; SEVERABILITY

This Agreement constitutes the entire agreement between the parties with respect to the rental of the Vehicle and supersedes all prior agreements and understandings. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

16. MISCELLANEOUS

Renter consents to Owner's reasonable inspection of the Vehicle during the rental term. Renter shall be responsible for any fines, tolls, parking violations, or other citations accruing during the rental term.
