CASp Real Estate Agreement

This CASp Real Estate Agreement (the Agreement) is entered into as of by and between the parties identified below. The parties agree that the matters described herein concerning accessibility evaluation, certification, remediation obligations, and allocation of costs will be governed by the terms set forth in this Agreement.

CASp Inspection and Certification

The Buyer shall have an exclusive CASp inspection period of days commencing on the date of acceptance of this Agreement. The CASp inspection shall be performed by the inspector identified below, in accordance with the applicable accessibility evaluation standards. The CASp inspector shall deliver a written report (CASp Report) to Buyer and Seller no later than .

If the CASp Report identifies accessibility violations, Buyer may, within the inspection period, either (a) accept the property as-is; (b) request Seller to cure identified CASp deficiencies prior to closing; or (c) terminate this Agreement and receive a full refund of earnest money. Seller shall respond in writing to any cure request within five (5) business days of receipt of the CASp Report, stating whether Seller will cure and proposing a schedule and cost allocation.

Disclosures

The Seller discloses the following known conditions affecting the Property. If unknown, mark the No box. These disclosures are made to the best of Seller's actual knowledge.

Default, Remedies, and Indemnity

In the event of breach by either party, the non-breaching party shall be entitled to specific performance, damages, or other remedies available at law or equity. The breaching party shall be liable for reasonable costs, including attorneys' fees and costs, incurred by the non-breaching party in enforcing this Agreement if the non-breaching party prevails. Seller and Buyer each agree to indemnify and hold harmless the other from third-party claims arising from acts or omissions of the indemnifying party related to CASp matters prior to closing.

Notices

All notices required or permitted under this Agreement shall be in writing and delivered to the addresses below by personal delivery, certified mail (return receipt requested), or nationally recognized overnight courier and shall be effective upon receipt.

Miscellaneous

This Agreement constitutes the entire agreement between the parties with respect to CASp inspection, certification and remediation obligations and supersedes all prior negotiations and agreements. No amendment shall be effective unless in writing and signed by both parties. The parties acknowledge that this Agreement allocates responsibility for accessibility matters and does not limit any statutory consumer protections unless permitted by law.

Governing law: The laws of shall govern this Agreement without regard to conflict of laws principles.

Acknowledgment and Certification

Each party represents and warrants that the person signing on its behalf is authorized to bind that party to the terms of this Agreement. Seller certifies that the disclosures provided herein are true and complete to Seller's actual knowledge. Buyer acknowledges receipt of any existing CASp Report provided prior to execution and understands that any CASp evaluation is a point-in-time assessment and not a guarantee of future compliance.
