Conditions of Adoption

The Adopter agrees to provide humane care, including adequate food, water, shelter, veterinary care and attention appropriate to the age and condition of the cat. The Adopter shall not knowingly abandon, mistreat, or transfer ownership of the cat to a third party without prior written consent of the Adopting Organization.

The Adopter agrees to obtain licensing/registration as required by local law. Adopter must notify the Adopting Organization of any change of address or primary phone number within 30 days.

Health Warranty; Returns; Euthanasia

Except as expressly disclosed in the Medical and Behavior section above, the Adopting Organization represents that, to the best of its knowledge, the animal is free of serious contagious disease at the time of transfer. The Adopter accepts the animal primarily "AS IS" and acknowledges that some illnesses may not be apparent at the time of adoption.

If a serious undisclosed illness exists at the time of adoption, the Adopter shall obtain a written diagnosis from a licensed veterinarian within 14 days of adoption and present it to the Adopting Organization. If the diagnosis establishes that the condition preexisted the adoption and was not disclosed, the Adopting Organization will accept return of the animal and will refund the adoption fee, less expenses incurred, or provide an alternative remedy as agreed in writing.

The Adopter shall not euthanize the animal without prior written authorization from the Adopting Organization except where immediate action is required to prevent extreme, unmanageable pain and suffering, in which case the Adopter shall retain all veterinary records documenting the emergency and promptly notify the Adopting Organization.

Transfer of Records & Microchip

The Adopting Organization shall provide available medical records and microchip information at the time of transfer. The Adopter agrees to register the microchip in the Adopter's name within 30 days and to provide proof of registration upon request.

Limitation of Liability; Indemnification

To the fullest extent permitted by law, the Adopting Organization makes no warranty as to the health, temperament, or behavior of the animal beyond the limited remedies expressly set forth in this Agreement. The Adopter releases, indemnifies, and holds harmless the Adopting Organization, its agents and volunteers from any claims, damages, liabilities or expenses arising from the care, custody or actions of the animal after adoption.

Governing Law; Entire Agreement

This Agreement is governed by the laws of the state or jurisdiction where the Adopting Organization is located. This Agreement constitutes the entire agreement between the parties and supersedes any prior promises or representations, whether written or oral, concerning the adoption of this animal. If any provision is held unenforceable, the remaining provisions remain in force.
