CERTIFICATE OF EFFECTIVENESS OF UNIT STATE: COUNTY: NAME OF UNIT: EFFECTIVE DATE: This Certificate of Effectiveness (the “Certificate”) is signed by and on behal f of (Name) , (Address) , the designated Unit Operator (the “Operator”), in the Unit Agreement (the “Agreement”) dated to be effective (Date) , a counterpart of which is recorded in Volume _____, page ____, of the _____ records of _____ County, _____. The Agreement serves to unitize the _____ Formation in lands and leases located in _____ County(ies), _____, which are more fully described in Exhibits to the Agreement. The description of those lands and the leases contained in the Exhibits to the Agreement are incorporated into this Certificate for all purposes, and reference is made to the Agreem ent for a full description of those lands and leases. The necessary approvals and commitment to the Agreement has been obtained from the Owners, as identified in the Agreement, for it to become effective, according to its terms. This Certificate is executed by Operator and recorded in the records of the County(ies) where t he lands and leases included in the Unit are located, as notice that all prerequi sites to establishing and creating the Unit, as provided for in the Agreement, have been timely satisfied, and that the Unit established by the Agreement is deemed to be in effect and all the lands and leases included in the Unit, are deemed, effective as of the Effective Date stated above, to constitute and comprise the (Name) , Unit, all as provided for in the Agreement. This Certificate is executed by the undersigned, as the designated Operator of the Unit , on the date of the acknowledgment of the signature below, but is deemed to be effecti ve as of the Effective Date stated above.
