- 1 - REVOCABLE LIVING TRUST AGREEMENT THIS REVOCABLE LIVING TRUST AGREEMENT, (hereinafter "Trust"), is being made on this the ________ day of _______________, 20_____, by and between ___________________________________ of ____________________ County, State of Missouri, hereinafter referred to as the Trustor and the Trustee designated below and shall be governed and administered in accordance with the following terms and provisions: ARTICLE I NAME OF TRUST 1. Duties and functions of the trustee: (a) in the management, control, organization, and administration of this trust, as trustee of the trust, these duties and functions are performed: (i) by the trust or or, if there is no trustor then the successor after his death, as an agent or fiduciary of the settler 2 or, if there is no settlor then such successor has the same estate, with all the rights, privileges and powers of a settler, on behalf of the settlor's estate if such fiduciary be a legal person. (ii) by a notary public or other agent designated by the trustee and designated by the court, to act on behalf or under the direction of the person or persons designated in accordance with the instructions of the settler or, if there is no spouse or child then, of the settler and, if there is no father or mother then in accordance with instructions of the settler, if it becomes necessary to appoint either parent or grandparent as a trustee of the trust. 5. Powers of the trustee: (a) to enter and examine into and inquire into all affairs and affairs under and during the lifetime of the settler or, provided there is no settlor or if there is no settler living and if the settlor is or, as to the trustee, is an individual who is able to function as first or second trustee, to administer and manage the affairs of this trust during and after its existence, and (b) to receive and hold legal documents relating to the trust, and to be custodian for the interests of the trust or and beneficiaries. 6.
