Exclusions (Standard & Notable)

The policy does not provide coverage for: intentional acts, known claims prior to policy inception, contractual liability assumed under a contract except to the extent required by law, pollution liability except as endorsed, professional errors and omissions, and nuclear hazard. Specific exclusions applicable to this policy are set forth in the endorsements attached hereto.

Conditions and Duties

Insuring Agreement: Subject to the terms, conditions, limitations and exclusions of this policy, the insurer agrees to pay those sums that the insured becomes legally obligated to pay as damages because of bodily injury, property damage, or personal and advertising injury to which this insurance applies. The insurer shall defend the insured against any suit seeking those damages, even if any of the allegations of the suit are groundless, false or fraudulent, subject to the limits of insurance.

Notice of Claim: As a condition precedent to coverage, the insured must provide written notice of any incident or claim as soon as practicable and, in no event, later than the notice periods specified in the applicable endorsement. Failure to provide timely notice entitles the insurer to deny coverage only to the extent prejudice is demonstrated.

Cooperation and Subrogation: The insured shall cooperate with the insurer in the investigation, settlement and defense of claims. The insurer shall be subrogated to the insured's rights of recovery against any person or organization to the extent of any payment made under this policy.

Endorsements and Amendments

Premium Payment and Audit

Premium is due in accordance with the policy schedule. The insurer reserves the right to audit records of the insured relevant to premium determination. Any additional premium found due following audit is payable by the insured on presentation of the audit statement.

Declarations and Certification

By signing below, the undersigned insured certifies that all information provided in this policy and any application forming the basis for this policy is true and complete to the best of the undersigned's knowledge. The insured acknowledges receipt of the policy and agrees to be bound by its terms, conditions, and exclusions. What the CGL BOR Insurance Policy Is and when it applies

The CGL BOR Insurance Policy is a Commercial General Liability (CGL) form variant that memorializes binding obligations of risk transfer between insurer and policyholder, often used where a binder of coverage (BOR) or short-form policy evidence is required. It records coverages, limits, named insureds, policy period, endorsements, and any special conditions such as additional insured endorsements or waiver of subrogation. For brokers and risk managers, it functions as immediate coverage evidence while the full policy is issued; for claims and certificate recipients, it clarifies who is covered and under what terms.

Why accurate CGL BOR completion matters

A correctly completed CGL BOR Insurance Policy ensures coverage triggers, avoids coverage gaps, and creates a clear record for claims, certificates, and contract compliance. Accurate entries reduce underwriting delays and minimize disputes over who or what is covered during a project or transaction.

Why accurate CGL BOR completion matters

Who normally completes and relies on this policy

Several roles interact with a CGL BOR Insurance Policy during placement, contracting, and claims lifecycle.

  • Insurance broker handling placement, endorsements, and binder issuance for clients and carriers.
  • Risk manager or corporate purchaser verifying contract-required limits and additional insured status.
  • Claims administrator or third-party requesting evidence to determine coverage applicability during a loss.

Each role must confirm names, effective dates, limits, and endorsement language to ensure insurance matches contractual obligations.

Primary parts of a professional CGL BOR Insurance Policy

A comprehensive CGL BOR includes identification fields, policy period, coverage sections, limits and deductibles, endorsements or endorsements summary, and issuer signature or insurer authorization.

Insured

Full legal name of the insured party, including DBA and corporate suffixes where applicable; used to match contracts and certificates.

Policy Period

Start and end dates with specific times; determines coverage window and interacts with retroactive or prior acts language if present.

Coverages

Listed coverage parts (e.g., bodily injury, property damage) and any sub-limits or aggregate limits relevant to the binder.

Limits

Per-occurrence and aggregate limits must be stated numerically and in words when possible to prevent ambiguity.

Endorsements

Any additional insured endorsements, waiver of subrogation, primary/noncontributory language, or exclusions summarized and attached.

Issuer

Name and contact of the issuing insurer or authorized broker, plus signature, stamp, or electronic authorization details.

Essential data elements to include

Named Insured: Full legal entity name
Policy Dates: MM/DD/YYYY range
Coverage Limits: Per-occurrence and aggregate
Endorsements: List and short description
Insurer Identity: Carrier name and NAIC number
Authorization: Signature or electronic approval

Step-by-step: completing the CGL BOR Insurance Policy

Follow these sequential steps to prepare a compliant and usable CGL BOR for contracting and claims support.

  • 01
    1. Verify parties: Confirm insured and additional insured legal names match contracts.
  • 02
    2. Enter dates: Set effective and expiration dates in MM/DD/YYYY format.
  • 03
    3. Confirm limits: Record per-occurrence and aggregate limits numerically.
  • 04
    4. Authorize issuance: Obtain insurer or broker signature and save audit trail.

How to configure an online CGL BOR workflow

Set up conditional fields, signer roles, and routing rules so the binder flows to underwriters, brokers, and insureds in the right order.

Field Configuration
Signer Roles Insurer | Broker | Named Insured
Conditional Fields Show endorsements only if selected
Authentication Email link, SMS code, or KBA
Retention Auto-archive signed PDF with audit trail

Where to send and file the completed policy

A clear routing path keeps evidence current and accessible for contracting, certificate issuance, and claims.

  • Issue to Broker: Send signed copy to broker for placement records.
  • Deliver to Insured: Provide insured with signed BOR and endorsements.
  • File with Carrier: Carrier retains original in underwriting file.
  • Share with Certificate: Use BOR data to prepare COI or certificate.

Digital signing and eSubmission requirements

Use a platform that provides secure signatures, an auditable trail, and configurable authentication for multi-party insurance binders.

  • Document formats: PDF, DOCX accepted
  • Authentication options: Email, SMS, KBA, SSO
  • Audit capabilities: Timestamps and IP logging

Ensure the chosen platform supports retention of the executed PDF and a tamper-evident audit trail to satisfy underwriting and claims recordkeeping needs.

Key timelines and response expectations

Track effective dates, binder issuance deadlines, and notice periods to avoid coverage lapses or contractual noncompliance.

Binder issuance:

Issue immediately upon underwriting approval to provide immediate evidence

Certificate requests:

Respond to COI requests within contractual timeframes, commonly 1–5 business days

Endorsement changes:

Process endorsements as soon as exposure changes are reported

Claims notice:

Policyholders must report claims per policy conditions without undue delay

Document retention:

Archive executed BOR for contract lifecycle and potential audits

Common mistakes to avoid when preparing the CGL BOR

  • Using trade names rather than the insured's legal entity, which can invalidate coverage or prompt certificate re-issuance.
  • Failing to attach or reference the specific endorsement forms, leaving ambiguity about additional insured scope or primary/noncontributory status.
  • Entering incorrect dates or ambiguous time zones that create apparent gaps between a binder and the full policy effective time.
  • Not preserving an auditable signature trail—missing timestamps, IP data, or signer attribution complicates dispute resolution.

Consequences of inaccurate or incomplete BOR documentation

Coverage Gap: Potential denial of coverage for uncovered exposures
Contract Breach: Civil liability for failing to meet contract insurance requirements
Regulatory Penalties: Possible fines if filings are regulated
Claim Delays: Slower claim payment and increased dispute risk
Underwriting Action: Policy rescission or premium adjustment
Reputational Risk: Trust damage with counterparties

Downloads and supporting documents to attach

Include the executed BOR plus any endorsements, declarations pages, and certificate templates so recipients have complete evidence of coverage and applicable exceptions.

Signed BOR

Save as a tamper-evident PDF with embedded audit trail and access controls to preserve the signing history.

Endorsements

Attach full endorsement text or a scanned copy rather than relying on summary language to avoid interpretation disputes.

Declarations Page

Include the declarations page showing rated entities, policy period, and premium allocation when relevant to exposure determination.

Certificate of Insurance

Provide COI only as a summary; attach the BOR for binding terms and additional insured specifics.

Real-world examples of CGL BOR usage

These condensed examples show how binders and short-form policies operate in practice across organizations.

Optica Ventures (Brokerage)

A broker issued a BOR to cover tenant improvements while the full policy processed

  • Binder provided immediate proof of coverage to the landlord
  • The broker retained the signed PDF and audit trail, then delivered the full policy to confirm limits and endorsements within five business days.

Martin Properties (Property Owner)

An owner required a contractor to produce a BOR before site access was granted

  • The contractor obtained binder evidence to meet the access condition
  • The BOR specified additional insured status, and the owner used that BOR to verify compliance during project mobilization.

Typical authorized signers for a CGL BOR

Broker — Authorized Representative

A licensed broker or producer authorized by the insurer may sign a binder; the narrative should include license number, firm name, and broker contact details to establish authority.

Carrier Underwriter — Approver

Carrier underwriters or delegated authority staff sign to bind coverage; signatory details and underwriting file references should be recorded for auditability and claims handling.

How a CGL BOR differs from similar documents

Compare the CGL BOR Insurance Policy with a full CGL policy and a certificate of insurance to avoid confusion about binding effect.

Criteria CGL BOR Full CGL Policy Certificate of Insurance
Purpose immediate evidence full contract summary only
Binding Effect
Typical Duration short-term policy term n/a
Signatures Required insurer or broker insurer not required
