What a Cheerleading Services Agreement Is

A Cheerleading Services Agreement is a written contract between a provider of cheerleading performances, coaching, or event staffing and a client such as a school, event organizer, or promoter. The agreement defines scope of services, schedule, compensation, travel and accommodation responsibilities, equipment and uniform provisions, safety and insurance obligations, media and intellectual property rights, cancellation and force majeure terms, and termination procedures to reduce disputes and allocate risk clearly.

Why a Clear Agreement Matters

A Cheerleading Services Agreement clarifies obligations, allocates risk, documents payment and cancellation terms, and preserves recourse for nonperformance. Properly executed, it creates enforceable rights under ESIGN and UETA when signed electronically and helps avoid costly disputes and unexpected liabilities.

Why a Clear Agreement Matters

Who Typically Uses This Agreement

Event organizers, school athletic departments, cheer companies, and independent coaches commonly use this contract when engaging or providing cheer services.

  • High schools and colleges hiring teams for halftime shows, pep rallies, or competitions.
  • Event producers contracting exhibition squads for corporate events, parades, or community festivals.
  • Cheer companies and independent coaches contracting choreography, clinics, private lessons, or specialty routines.

Use the agreement whenever performances, paid clinics, travel, media usage, or minors are involved to document responsibilities and protections for all parties.

Key Clauses to Include in the Agreement

Core contract clauses cover scope of services, performance schedule, payment terms, liability allocation, media and IP rights, and termination procedures to ensure clear expectations and enforceability.

Scope of Services

Describe specific performances, routines, coaching sessions, clinic formats, number of performers, duration, breaks, and any rehearsal obligations. Attach schedules and staffing levels as exhibits to avoid misunderstandings about deliverables.

Compensation

Specify fees, deposit amounts, payment schedule, late fees, reimbursement for travel and accommodations, and conditions for bonus or overtime pay. State who is responsible for expenses and invoice timing to prevent disputes.

Schedule & Logistics

List performance dates, call times, rehearsal dates, load-in and load-out windows, equipment needs, parking, and contact persons. Include contingency plans for delays or weather-related changes to avoid last-minute confusion.

Liability & Insurance

Allocate responsibility for injuries, property damage, and participant conduct. Require proof of liability insurance and indemnities where appropriate; state limits and any waiver language consistent with local law and safety standards.

Media & IP

Define ownership and license of recordings, photographs, and choreography. Specify rights to use performer likenesses for promotion and outline approval requirements for commercial uses and third-party licensing.

Cancellation & Termination

Set notice periods, refund or forfeiture rules for deposits, force majeure definitions, and cure periods for breaches. Include termination for convenience and breach remedies to limit exposure.

Typically due 14 days before performance

Insurance Proof:

Certificate due at least 10 days pre-event

Cancellation Notice:

Common Mistakes to Avoid

  • Failing to specify the number of performers or exact routine length can lead to short staffing, unmet expectations, and disputes over final payment.
  • Using vague payment terms such as 'upon completion' without deadlines or invoice schedules delays payments and complicates remedies for late fees.
  • Omitting insurance requirements or acceptable coverage limits increases exposure for both parties when injuries or property damage occur during rehearsals or events.
  • Not addressing travel, accommodation, or meal responsibilities often causes last-minute costs and contractual disagreements when out-of-town performances are scheduled.

Penalties and Risks of an Incorrect Agreement

Deposit Forfeiture: Loss of deposit amount
Breach Damages: Monetary liability for nonperformance
Insurance Denial: Claims refused for missing coverage
Tax Withholding: Backup withholding risk
Permit Violations: Fines or event cancellation
Reputational Harm: Lost future bookings
