What a Child Performance Agreement Is and When It’s Used

A Child Performance Agreement is a written contract between a production company (or employer) and the parent or legal guardian of a minor who will perform in live events, film, television, commercials, theater, or other paid performances. It defines the minor’s role, permitted hours, schooling and tutoring provisions, health and safety measures, compensation, and any trust or protected-account arrangements for earnings. The agreement often references state child labor and entertainment laws, work permits, and may include guardian-on-set designations, medical authorizations, and recordkeeping requirements. Electronic execution is generally accepted under U.S. e-signature laws such as ESIGN and UETA when requirements are met.

Why a Clear Agreement Matters for Minors in Performance

A documented agreement protects the child’s legal and financial interests, sets expectations for hours and schooling, and makes compliance with child-labor and entertainment rules demonstrable for producers and guardians.

Why a Clear Agreement Matters for Minors in Performance

Common Parties Who Prepare or Sign a Child Performance Agreement

Typical users include the production employer, the minor’s parent or guardian, and legal counsel or child welfare officers when required.

  • Production companies and talent agencies that hire minors for paid roles and need written, enforceable terms.
  • Parents or legal guardians who must consent, authorize medical care, and manage protected earnings on behalf of the child.
  • Entertainment attorneys, labor compliance officers, or school liaisons who review permits, tutoring plans, and statutory protections.

Each signer has distinct responsibilities: employers set conditions; guardians consent and protect the minor’s interests; counsel ensures legal compliance.

Core Parts of a Professional Child Performance Agreement

A robust agreement groups essential items into clear sections so signers and regulators can verify compliance quickly and reduce disputes.

Parties

Identifies the minor, parent/guardian, employer, and any third-party payees; establishes legal capacity and contact details.

Performance Details

Specifies role, dates, locations, rehearsal times, and any limitations on stunts or hazardous activities.

Compensation

States gross pay, schedule of payments, payroll withholding responsibility, and whether a protected trust (Coogan-style) will receive a portion of earnings.

Schedule & Education

Lists permitted hours, meal breaks, required tutoring or on-set schooling, and coordination with the child’s academic obligations.

Health & Safety

Covers medical authorization, emergency contacts, insurance responsibilities, and required safety protocols on set.

Signatures & Authentication

Includes signature blocks for guardian and employer, notarization or witness lines if required, and e-signature authentication methods used.

Step-by-Step: Completing and Executing the Agreement

Follow these steps to prepare, review, and execute a Child Performance Agreement that meets common legal and production standards.

  • 01
Draft Terms: Populate role, dates, hours, compensation, and education plan.
  • 02
Verify Eligibility: Confirm age, obtain work permit, and identify required tutoring or welfare officers.
  • 03
Review & Approve: Have counsel or compliance officer check statutory and trust requirements.
  • 04
Sign and Authenticate: Parent/guardian and employer sign; notarize or use e-signature method if required.

How Electronic Execution and Delivery Typically Work

Modern e-sign workflows reduce delay while preserving a verifiable audit trail; follow a clear routing order for signatures and attachments.

  • Upload Document: The producer uploads the finalized agreement to the signing platform.
  • Assign Signers: Add guardian, producer rep, payroll contact, and any witness or notary roles.
  • Set Authentication: Choose email link, SMS code, or stronger ID verification as needed.
  • Send and Record: Send signing invites; the platform captures timestamps, IP, and completion certificates.

Typical Online Workflow Settings for Child Performance Agreements

When configuring an e-sign workflow, select settings that preserve identity, maintain records, and attach required permits or medical authorizations.

Field Configuration
Signers and Order Guardian first, production rep next, payroll last.
Authentication Level Email plus SMS or ID verification for stronger assurance.
Attachments Attach permit, ID, medical release, and tutoring plan.
Retention & Audit Enable audit trail and export signed PDF with certificate.

Digital Signing Requirements and Integration Notes

Choose a platform that provides reliable audit trails, flexible authentication, and integration with payroll or talent management systems.

  • Authentication: Email, SMS, or ID-proofing options
  • Audit Trail: Persistent timestamp and action log
  • Integrations: Connects to HR, payroll, or cloud storage

Common Deadlines and Time-Sensitive Actions

Certain actions must occur before or at the start of performance; missing them can trigger fines, production stoppage, or permit refusal.

Work Permit Issuance:

Obtain the minor’s performance permit from the issuing authority before first day of work.

Trust Deposit Timing:

Deposit mandated portion into protected account per state timing rules, typically at payroll disbursement.

Tutoring Schedule:

Provide tutoring hours and schedule before the child’s first performance day.

Document Retention Start:

Retain executed agreement from signing date for the applicable retention period.

Permit Renewal:

Renew any time-limited permits before they expire during an ongoing engagement.

Key Milestones from Draft to First Performance

Track these sequential milestones to keep compliance and production schedules aligned.

01

Draft Complete

Agreement terms finalized and attachments prepared prior to review.

02

Guardian Review

Parent or guardian reviews terms, clarifies schooling and medical authorizations.

03

Permits Issued

Work permit and any educational waivers obtained and attached.

04

First Day Compliance

Signed agreement, permit, and on-set welfare provisions are in place before first performance.

Common Preparation Mistakes to Avoid

  • Vague hours and break language that conflict with state child-labor rules and create scheduling disputes on set.
  • Failing to specify tutoring or educational arrangements, which can violate permit conditions and delay production.
  • Omitting protected-earnings provisions where required by state law, risking guardian disputes and payroll issues.
  • Using weak signer authentication or not capturing an audit trail, which can undermine enforceability and recordkeeping.

Security and Compliance Elements to Include

Encryption: TLS in transit; AES-256 at rest
Audit Trail: Timestamp, IP, signer actions
HIPAA Consideration: BAA when health data included
ESIGN/UETA: Legal e-sign compliance
Notary Options: In-person or RON where allowed
Access Controls: Role-based permissions

Legal Risks and Financial Consequences of Errors

Labor Violations: Fines and work stoppage
Trust Noncompliance: Court-ordered remedies
Tax Withholding Errors: Payroll penalties
Invalid Consent: Agreement voidability risk
Data Breach: Regulatory penalties
Permit Lapse: Production disruption
