CHILD SUPPORT AGREEMENT FORM

This Child Support Agreement ("Agreement") is made and entered into on this day of , by and between Parent A: whose mailing address is , and Parent B: whose mailing address is .

Recitals

WHEREAS, the parties are the biological or legal parents of one or more minor children and wish to resolve child support obligations without further court action; and

WHEREAS, the parties seek to establish a written agreement setting forth the amount, method, and terms of support, allocation of medical and educational expenses, and procedures for modification and enforcement; and

WHEREAS, the parties acknowledge that this Agreement is intended to be a binding contract that may be submitted to a court for approval or enforcement.

NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows:

1. Definitions

For purposes of this Agreement the following definitions apply: "Children" means the natural or adopted children specifically listed in Section 2; "Effective Date" means the date set forth above; "Net Income" means gross income less mandatory payroll deductions required by law; "Extraordinary Medical Expenses" means reasonable unreimbursed medical, dental, orthodontic and psychological expenses in excess of routine co-payments and deductibles.

8. Modification

This Agreement may be modified only by a written instrument signed by both parties or by a subsequent order of a court of competent jurisdiction. A material change in circumstances, including a substantial and continuing change in income, medical insurance availability, or custody, constitutes grounds for modification. Any agreed modification shall expressly state that it supersedes prior inconsistent provisions.

9. Enforcement and Remedies

The parties acknowledge that this Agreement may be enforced by income withholding, contempt proceedings, or any other remedy available under law. The prevailing party in any enforcement action shall be entitled to recover reasonable attorneys' fees, court costs, and collection expenses. Interest on overdue support shall be as stated in Section 4.

10. Duration and Termination

Support obligations under this Agreement shall continue until the Children reach the age of or until emancipation, death, adoption, or as otherwise required by law. Support may be extended for post-secondary education if specifically agreed in writing.

11. Notices

All notices required or permitted under this Agreement shall be in writing and delivered to the parties at the addresses below by personal delivery, certified mail, or overnight courier. Notices shall be effective upon receipt.

12. Governing Law; Entire Agreement; Severability; Miscellaneous

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to its conflict of law principles. This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior oral or written agreements. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Any amendment or waiver must be in a signed writing. Failure to insist on strict performance of any provision shall not be deemed a waiver of any other provision. This Agreement may be executed in counterparts and delivered by electronic transmission of an executed signature page.

13. Certifications

Each party warrants and represents that the information provided in this Agreement is true and correct to the best of their knowledge, and each party acknowledges that making a false statement may subject the maker to penalties including contempt or perjury under applicable law.
