What a Choreography Agreement Covers

A Choreography Agreement is a written contract that defines the creation, ownership, licensing, compensation, and permitted uses of a choreographed work between a choreographer and a commissioning party. It sets scope of services, rehearsal and performance schedules, payment terms, credit and attribution, rights to choreography recordings, and conditions for revisions or cancellations. The agreement clarifies whether the choreographer assigns copyright, licenses limited performance rights, or retains moral rights. Properly drafted, it reduces disputes over payment, reuse, touring, and derivative works and provides remedies for breach or unauthorized exploitation.

Why a Written Agreement Matters

Use a Choreography Agreement to establish rights, payment, schedules, and attribution before rehearsals begin. It protects both parties by documenting ownership and permitted uses, reduces litigation risk, and creates clear expectations for compensation, licensing, recorded performances, and third-party use.

Why a Written Agreement Matters

Who Commonly Uses a Choreography Agreement

Designed for choreographers, producers, and presenters who need written clarity on rights, compensation, and scheduling.

  • Independent choreographers contracting for festivals, tours, or commercial projects and commissions.
  • Dance companies and producers hiring choreography for staged productions and touring schedules.
  • Institutions (schools, studios) commissioning work for curriculum, recitals, or promotional performances.

Clear allocation of rights and obligations streamlines rehearsals, performance planning, and future licensing or reuse negotiations.

Primary Roles and Responsibilities

Choreographer — Freelance

A freelance choreographer commissions and delivers original movement, negotiates fees, and may retain or license choreography rights. They need clear clauses on ownership, credit, royalties for reuse, recording permissions, and payment milestones to avoid misunderstandings during production and licensing.

Producer — Company

Producers, presenters, and company managers commission choreography, schedule rehearsals, and coordinate performers. They require transfer or license terms, indemnities, cancellation and postponement clauses, and recording permissions to manage budgets, touring rights, and promotional usage without legal uncertainty.

Core Clauses to Include

Core clauses and features a professional Choreography Agreement should include to protect rights, clarify payments, and govern permitted uses across productions.

Scope

Describe the choreographed material, rehearsal schedule, performance dates and locations, required dancers, and any deliverables such as notation or video. Specify boundaries for revisions and additional creative work to control scope creep.

Compensation

Set fees, payment schedule, deposit amounts, reimbursement policies for travel and accommodation, and penalties for late payment. Clarify whether royalties or residuals apply to future performances or commercial exploitation.

Rights

Specify whether the choreographer assigns copyright, grants an exclusive or nonexclusive license, and define permitted uses including live performance, recording, licensing, sublicensing, or derivative works.

Credits

Detail attribution wording, placement in programs and marketing materials, and whether credit appears on recordings or streaming platforms. Include exact phrasing and font size requirements where applicable for promotional materials.

Recording Rights

State permissions for audio and video capture, who may exploit recordings, revenue sharing for recorded performances, and limitations on distribution channels including online streaming and archival use.

Termination

Define termination triggers, notice periods, cure windows, refund or retention of deposit rules, and rights to cease performances or revoke licenses upon breach and post-termination usage reporting obligations.

  • Using vague credit clauses such as 'appropriate credit' creates disagreements; specify exact wording, placement, and promotional mediums for acknowledgement.
  • Neglecting permissions for video or photographic recordings can trigger licensing claims and prevent distribution on streaming platforms or in marketing materials.
