What a Citizenship Application Agreement Covers

A Citizenship Application Agreement is a written contract between an applicant and a representative, attorney, or service provider that sets out the responsibilities, fees, scope of assistance, and document-handling procedures related to a U.S. naturalization or immigration filing. The agreement typically describes which USCIS forms the representative will prepare or submit, any application support (e.g., document review, translations, form completion), payment terms, confidentiality and data protection measures, and who bears costs such as filing fees, biometrics, or legal counsel. It may also address consent for electronic signatures, retention of records, and dispute resolution.

Why a Written Agreement Matters for Citizenship Filings

A clear agreement reduces misunderstandings about services, timelines, and payment while documenting consent for representation and e-filing. It also creates an auditable paper trail useful in disputes or audits.

Why a Written Agreement Matters for Citizenship Filings

Who Commonly Uses a Citizenship Application Agreement

Typical signers include applicants, immigration attorneys, accredited representatives, authorized agents, and family members assisting with the application.

  • Immigration attorneys and law firms providing paid representation and legal advice for naturalization and adjustment applications.
  • Accredited representatives or nonprofit legal aid organizations assisting low-income applicants with form completion and filing.
  • Individuals or family members acting as paid or unpaid preparers who will submit or manage the applicant's materials.

The agreement helps clarify roles and ensures that consent, fee arrangements, and record-keeping preferences are documented for all parties involved.

Core Elements to Include in the Agreement

A comprehensive agreement balances practical details, legal protections, and compliance elements so both the applicant and the representative understand obligations and limits of service.

Scope of Services

Describe specific tasks (form selection, preparing I-485/I-130, document review, translations, interview coaching) and any excluded services such as representation at removal hearings.

Fees and Payment

State fixed fees, hourly rates, deposit requirements, refund policies, and which government filing or biometrics fees the applicant must pay directly.

Consent and Authorization

Obtain written authorization for the representative to prepare or file forms, receive USCIS communications, and to access applicant documents.

Electronic Records

Specify consent to receive electronic records and to sign documents electronically under ESIGN and applicable state UETA/ESRA rules.

Confidentiality

Explain how personally identifiable information (PII) and immigration records will be protected, and note HIPAA standards if health data are involved.

Termination and Dispute

Include how either party may end the relationship, final accounting of fees, and governing law for any disputes.

Step-by-Step: Completing the Citizenship Application Agreement

Follow these steps in sequence to finalize the agreement and prepare related filings.

  • 01
Step 1: Gather identification documents and USCIS form numbers.
  • 02
Step 2: Fill applicant data and scope of services clearly.
  • 03
Step 3: Agree fees, consent to eRecords, and sign electronically if permitted.
  • 04
Step 4: Retain copies and submit forms to USCIS or authorized filing service.

Where the Agreement Fits in the Filing Workflow

The agreement documents representation and precedes form preparation, signing, and submission to USCIS or other authorities.

  • Prepare: Representative completes forms and collects supporting evidence.
  • Authorize: Applicant signs agreement and authorizes submission or eSignature use.
  • File: Representative or applicant files forms with USCIS, paying required fees.
  • Track: Monitor receipt notices, biometrics scheduling, and interview appointments.

Digital Signing and Platform Considerations

When you plan to sign electronically, confirm the chosen platform meets legal and security requirements.

  • Authentication: Email, SMS, or multi-factor authentication options.
  • Audit Trail: Timestamp, IP, and signer attribution captured.
  • File Formats: PDF and DOCX accepted for records and USCIS attachments.

Common Mistakes to Avoid

  • Using an applicant name that differs from the government ID, which can trigger requests for correction or delays.

  • Neglecting to document consent for electronic delivery or eSign, leaving questions about enforceability under ESIGN.
  • Omitting a clear fee breakdown or refund policy, which often leads to billing disputes if an application is withdrawn.

Filing Delay: Application rejection or delay
Fee Loss: Nonrefundable USCIS fees
TIN Errors: Backup withholding risk
Unauthorized Practice: Civil penalties for nonattorney representation
Data Breach: PII exposure costs
