What the Client Intake POA Questionnaire Is

The Client Intake POA Questionnaire is a structured intake form used to collect essential data when preparing a power of attorney (POA). It captures principal and agent identities, contact and identification details, the scope and duration of delegated powers, health or financial preferences, and any supporting documents such as IDs and prior POAs. The questionnaire standardizes information for attorneys, fiduciaries, and administrative staff so a durable, limited, or springing POA can be drafted accurately and executed with the required notarization or witnessing steps.

Why a Standard Intake Questionnaire Matters

A standardized Client Intake POA Questionnaire reduces drafting errors, documents required facts consistently, and clarifies the principal’s intentions for scope and duration. It supports enforceability, speeds review, and helps confirm whether notarization, witnesses, or state-specific language are needed to satisfy local statutory requirements.

Why a Standard Intake Questionnaire Matters

Who Typically Completes This Questionnaire

The questionnaire is completed by the principal, an authorized representative, or administrative staff under attorney supervision to gather accurate, sign-ready information.

  • Estate planning attorneys and paralegals who draft POAs and manage execution logistics.
  • Financial institutions and trust officers verifying agent authority before account access.
  • Healthcare providers or medical records offices collecting health-care POA instructions.

Use by the right party ensures correct identity proofing, proper witness/notary steps, and that the resulting POA matches statutory formality for the governing state.

Core Sections to Include in a Professional Questionnaire

A thorough Client Intake POA Questionnaire organizes information into discrete sections so drafters can produce a clear, enforceable document without follow-up calls.

Principal Identity

Full legal name, date of birth, government ID details, contact information, and preferred mailing address for service or record delivery.

Agent Details

Primary and alternate agent names, relationships, contact methods, and acceptable substitute agents if the primary cannot serve.

Scope of Powers

Explicit list of financial, real estate, healthcare, or limited actions granted; any exclusions or conditions to limit ambiguity.

Effective Terms

Choose durable, springing, or immediate effect; specify triggering events and any termination conditions or time limits.

Safeguards

Identify successor agents, bonding requirements, co-agent rules, or oversight instructions to mitigate misuse.

Execution Details

Preferred signing venue, notarization or witness needs, and whether recording or delivery to third parties is required.

Step-by-Step: Completing the Questionnaire

Follow these steps to gather data, confirm identity, and prepare the POA for execution.

  • 01
Gather documents: Collect IDs, prior POAs, and relevant account numbers.
  • 02
Complete sections: Fill principal, agent, scope, and effective date fields.
  • 03
Review and initial: Confirm accuracy and initial each page if required.
  • 04
Sign and notarize: Execute with required witnesses or online notary as allowed.

Configuring an Online Workflow for the Questionnaire

Map questionnaire fields to a signing workflow to automate routing, authentication, and storage for a secure, auditable process.

Field Configuration
Authentication Email link, SMS OTP, or KBA depending on risk
Notary Enable RON or schedule in-person notary step
Conditional Fields Show agent details only when relevant powers selected
Retention Set automatic export to secure storage as PDF/A

How Digital Submission and Routing Operate

A digital workflow reduces handoffs and centralizes identity proofing and execution records.

  • Upload: Sender uploads the completed questionnaire and supporting IDs.
  • Assign roles: Designate principal, agents, and witnesses in order.
  • Request signatures: System sends signing invites with authentication steps.
  • Store: Signed PDF and audit trail are archived securely.

Platform and File Requirements for eSubmission

Use a platform that accepts PDF and DOCX inputs, supports required signer authentication, and captures a complete audit trail for legal defensibility.

  • File types: PDF, DOCX accepted for upload
  • Integrations: Salesforce, NetSuite, Google Workspace supported
  • Authentication: Email OTP, SMS, or KBA options

Ensure the chosen system retains tamper-evident signed PDFs, exports legal-compliant audit records, and can attach notarization certificates or RON session logs when required.

Timing Considerations and Typical Deadlines

POA processing is time-sensitive when coupled with transactions or tax deadlines; plan signing and delivery accordingly.

Immediate effect start:

Effective date in the questionnaire sets agent authority start.

Notarization window:

Schedule notarization before document-dependent transactions.

Bank acceptance:

Institutions may require original or certified copies promptly.

Record delivery:

Deliver executed copies to agents and affected institutions immediately.

Revocation notice:

Provide written revocation promptly when terminating authority.

Key Processing Milestones

Track milestones as a sequence from intake through execution and secure storage to ensure the POA is ready when needed.

01

Client intake

Collect completed questionnaire and ID documentation for verification.

02

Draft review

Attorney confirms scope language and state-specific formalities.

03

Signing & notarization

Schedule principal, witnesses, and notary or RON session.

04

Distribution & storage

Send executed copies to institutions and archive originals securely.

Common Mistakes to Avoid When Preparing the Questionnaire

  • Using nicknames or initials instead of the principal’s full legal name, which can block notarization or bank acceptance.
  • Leaving the scope of authority vague, such as 'all financial matters,' instead of listing specific powers and exclusions.
  • Failing to capture alternate agents or successor agent details, creating gaps if the primary agent is unavailable.
  • Not confirming state witness or notary requirements up front, resulting in an invalid or non-usable POA.

Risks and Consequences of an Incorrect Questionnaire

Invalid POA: Document may be unenforceable
Financial exposure: Unauthorized transactions risk losses
Agent disputes: Ambiguity increases litigation likelihood
Notary failure: Improper notarization can nullify execution
Delayed access: Institutions may refuse agent action
HIPAA breach: Incorrect authorizations risk privacy violations
