What the Client Non Borrower Document Is and when it’s used

A Client Non Borrower Document captures identifying and consent details from a person or entity that is involved in a transaction but is not the primary borrower. Typical uses include recording acknowledgements, third-party consents, agent authorizations, or spousal information for mortgage and lending workflows. The form clarifies the non-borrower role, collects contact and verification data, documents privacy or data-share consents, and creates an auditable record that lenders, title agents, and compliance teams can rely on during underwriting, closing, or post-closing reviews.

Why a clear Client Non Borrower Document matters

A well-crafted Client Non Borrower Document reduces ambiguity about obligations, protects lenders and third parties by documenting consent and identity, and supports downstream compliance and reporting. It creates a searchable, auditable record that helps reduce closing delays and legal risk while clarifying the non-borrower relationship for all parties involved.

Why a clear Client Non Borrower Document matters

Who typically prepares and signs this document

The Client Non Borrower Document is used by lending and closing teams, compliance staff, and any counterparty needing formal acknowledgement from a non-borrowing party.

  • Loan officers and underwriters who need third-party acknowledgements during underwriting and closing.
  • Title and escrow agents handling closing packages that include non-borrower consents or disclosures.
  • Compliance or legal teams documenting identity verification and consent for audit and recordkeeping.

The document is also provided to signers, title agents, and recordkeepers so each party has an exact record of the non-borrower’s consent and identifying information.

Typical roles tied to this document

Loan Officer

Prepares the packet and requests the non-borrower form to document consent or relationship; verifies completeness before submission to underwriting and records the signed document in the loan file.

Non-Borrower Signer

Provides identifying information and consent statements; must review and sign accurately since mismatches or missing fields can delay closing or trigger additional identity proofing requirements.

Data and security elements to include

Full legal name: Exact government name
Contact details: Phone and email address
Identification: Driver license or passport
Relationship: Role relative to borrower
Consent statements: Purpose and data sharing
Signature metadata: Timestamp and IP

Consequences of mistakes or missing information

Invalid signature: May invalidate the form
Processing delays: Closing date can slip
Regulatory fines: Possible audit findings
Backup withholding: Tax risk if TIN missing
Privacy violation: Improper PHI handling
Record retention lapse: Evidence unavailable later

Common preparation mistakes to avoid

  • Entering a nickname or abbreviated legal name that does not match government ID, which can require re-verification and delay closing.
  • Omitting the non-borrower’s relationship to the borrower, leaving the intent of the document unclear for underwriters or title examiners.
  • Failing to capture a clear consent statement about data sharing and third-party disclosures, which can cause compliance gaps.
  • Using handwritten corrections without initials or dates, creating ambiguity about whether changes were authorized and increasing legal risk.

Step-by-step: completing the Client Non Borrower Document

Follow a consistent sequence to reduce errors: verify identity, complete required fields, confirm consent language, obtain signature, and file the signed copy in the loan or compliance record.

  • 01
Verify identity: Check government ID and match full legal name
  • 02
Complete required fields: Enter contact, relation, and identification details precisely
  • 03
Capture consent: Ensure consent language is clear and specific
  • 04
Sign and store: Collect final signature and save to the loan file

How the document moves through a digital workflow

Core sections that make a professional Client Non Borrower Document

Include clear, standardized sections so reviewers and signers can locate and verify critical information quickly. The following elements support legal clarity, auditability, and regulatory compliance.

Parties and role

Identify the non-borrower and the primary borrower, state the non-borrower’s role or relationship, and include full legal names, addresses, and contact details for unambiguous attribution.

Purpose statement

Describe why the form is requested (e.g., acknowledgement, consent, agent designation) and the scope of any authorization so downstream users understand limits and intent.

Identity verification

Record the form of ID presented, ID number or last four digits as appropriate, and the method used to verify identity to support audit and fraud prevention activities.

Privacy and consents

Include explicit language about data sharing, disclosures required by law, and any permissions for the lender or third parties to access or use the non-borrower’s information.

Signature block

Provide a clearly labeled signature field, printed name, title when applicable, and date. Capture signature metadata (IP, timestamp) for enforceability and audit trails.

Notarization and witness

Reserve a space for notarization or witness acknowledgements if state law or lender policy requires it; include instructions for remote notarization where allowed.

Recommended digital workflow and field settings

Configure the eSignature workflow to reduce rework: set authentication, required fields, conditional rules, and retention settings to match your compliance needs.

Field configuration Mark name, relation, consent, and signature fields as required
Authentication method Use email + SMS or stronger KBA for higher-risk files
Conditional routing Show additional fields when specific answers are selected
Retention settings Automatically archive signed PDF and audit record
Notifications Alert owner and compliance on completion

Technical considerations for eCompletion and eSubmission

Ensure your platform supports secure uploads, signed PDF export, audit trails, and optional notarization or witness workflows before sending the form to signers.

  • Formats supported: PDF, DOCX, and fillable forms
  • Integrations: Connect to LOS, CRM, and cloud storage
  • Authentication: Email, SMS, or advanced KBA
