Limitation of Liability

Except for liability arising from willful misconduct, gross negligence, or Client's indemnification obligations, neither party's cumulative liability to the other for any claim arising under or related to this Agreement shall exceed the total fees paid by Client to Provider under this Agreement during the three months preceding the event giving rise to the claim.

What the Client SMS Request Form Is and Why It Exists

The Client SMS Request Form documents a recipient's informed consent to receive SMS or text-message communications from an organization. It records the mobile number, consent language, opt-out mechanics, purpose and frequency of messages, and a dated signature or electronic acknowledgement. Properly completed forms create an auditable record used to meet federal and state e-signature and consumer-protection requirements (for example, ESIGN Act 15 U.S.C. ch. 96 and applicable state UETA/ESRA rules) and support TCPA-related compliance and dispute resolution.

Why a Clear SMS Consent Form Matters

A concise Client SMS Request Form reduces legal risk, documents consent, and ensures consistent messaging practices. It provides written evidence of intent and attribution needed under electronic-signature rules and consumer-protection frameworks while improving deliverability and customer clarity.

Why a Clear SMS Consent Form Matters

Who Typically Prepares and Uses This Form

Teams that collect opt-in for business messages, each with different priorities.

  • Sales and Customer Success — Collects consent for appointment reminders, offers, and transactional alerts; ties opt-ins to CRM records.
  • Compliance and Legal — Maintains wording to meet ESIGN and consumer disclosure requirements; records retention for audits.
  • Healthcare and Billing Teams — Captures patient consent consistent with privacy and messaging policies when allowed by HIPAA workflows.

Assign a single owner for storage and periodic review so consent records remain complete and defensible.

Step-by-Step: Collecting SMS Consent with the Form

Follow these sequential steps to obtain and record valid SMS consent.

  • 01
Prepare Form: Use standard consent language and opt-out instructions.
  • 02
Confirm Identity: Verify recipient name and mobile number before collecting consent.
  • 03
Obtain Consent: Have recipient sign or accept the electronic acknowledgement.
  • 04
Store Record: Save the completed form and audit metadata for retention.

Simple Workflow: From Request to Messaging

A straightforward flow reduces friction and creates an auditable trail for each SMS opt-in.

  • Request Consent: Deliver the form via web, email link, or paper.
  • Sign or Acknowledge: Recipient signs or checks an electronic consent box.
  • Store Evidence: Record timestamp, IP, and user agent in the audit trail.
  • Begin Messaging: Send messages only per the disclosed purpose and frequency.

Technical Requirements and Integrations for Electronic Use

Confirm the technical stack before using the electronic Client SMS Request Form.

  • SMS Gateway: Supports short code and long code
  • eSignature System: Produces audit trail metadata
  • CRM Integration: Syncs consent flags to records

Typical integrations include SMS providers and CRM systems; supported platforms commonly include Salesforce, Microsoft 365, Google Workspace, and storage systems like Box or Google Drive for archival.

Recommended Digital Workflow Settings

Configure fields and automation to reduce manual errors and preserve compliance metadata.

Field Configuration
Mobile Number Field Require E.164 or +1 format validation
Consent Checkbox Record timestamp and IP when checked
Opt-Out Field Populate with standard STOP instructions
Audit Recording Enable automatic capture of device and session data

Essential Elements to Include on the Form

A compliant Client SMS Request Form combines clear wording with technical evidence and retention controls.

Clear Consent

Unambiguous language stating that the recipient consents to receive SMS messages for the named purpose, including expected frequency.

Opt-Out Mechanism

Explicit instructions for opting out (reply STOP, a link, or other simple method) to satisfy consumer expectations and reduce complaints.

Attribution Data

Capture signer metadata — timestamp, IP address, device — so intent and attribution can be demonstrated if challenged.

Retention Notice

State how long consent records will be retained and provide contact details for questions or revocation.

Purpose and Frequency

Specify message types (reminders, alerts, marketing) and approximate message frequency to ensure informed consent.

Signature Method

Allow a handwritten signature, typed name with click-to-sign, or an electronic signature consistent with ESIGN/UETA requirements.

Security and Compliance Controls to Capture

Encryption: TLS 1.2/1.3 in transit, AES-256 at rest
Audit Trail: Timestamped events and signer metadata
Access Controls: Role-based user access
BAA Option: HIPAA BAA available where required
Standards: SOC 2 Type II and ISO 27001
21 CFR Support: Compliant options for FDA-regulated records

Key Legal Risks If Consent Is Inadequate

TCPA Exposure: Statutory damages risk (TCPA)
Contract Dispute: Failure to prove consent
Regulatory Audit: Records unavailable for inspection
Reputational Harm: Customer complaints and blocking
Data Breach: Improper storage of personal data
Invalid E-Signature: Missing ESIGN/UETA requirements

Common Mistakes to Avoid When Preparing the Form

  • Using vague consent language that fails to state purpose or frequency, creating ambiguity in disputes and compliance reviews.
  • Collecting numbers without verifying ownership or country code, which increases failed deliveries and complaint risk.
  • Omitting clear opt-out instructions or burying them in small print, which can trigger consumer-protection complaints.
  • Failing to record technical evidence (timestamp, IP, session) that proves who consented and when.

Time-Sensitive Rules and Retention-Related Deadlines

Observe specific legal retention and disclosure obligations that affect how long consent records must be kept and how disclosures are presented.

ESIGN Consumer Disclosure:

Provide required consumer disclosure per 15 U.S.C. §7001(c)

HIPAA Retention:

Retain health-related records for 6 years (45 CFR §164.530(j))

Record Access:

Ensure electronic records can be reproduced on demand for regulators

State Variation:

Confirm state-specific retention or disclosure rules before use

Audit Readiness:

Maintain searchable audit trails for investigations
