What a Client Trust Questionnaire Is and When It’s Used

The Client Trust Questionnaire is a standardized document used by professional service firms to collect and verify information about a client’s identity, relationship, and the management of funds or confidential materials held in trust. It typically records legal names, contact details, tax identifiers, authorized signers, purpose of trust, and controls for handling client funds. Organizations use it during onboarding, KYC checks, compliance reviews, and audits to establish responsibilities and reduce operational risk. The form can be completed on paper or electronically and stored according to applicable retention rules.

Why a Completed Questionnaire Strengthens Compliance and Clarity

Using a Client Trust Questionnaire clarifies fiduciary duties, documents client consent, and supports regulatory compliance under the ESIGN Act (15 U.S.C. ch. 96) and UETA when signed electronically. Accurate questionnaires streamline audits, reduce disputes over authority, and preserve an evidentiary record of client instructions and identity verification.

Why a Completed Questionnaire Strengthens Compliance and Clarity

Typical Teams and Roles That Complete the Questionnaire

Legal, financial, and property management teams typically gather Client Trust Questionnaire data during onboarding and compliance reviews.

  • Law firms and attorneys managing client funds or escrow accounts.
  • Accounting and financial firms conducting KYC and tax reporting obligations.
  • Real estate and property managers who hold deposits, escrows, or trust funds.

Use consistent procedures and documented signatory authority to reduce disputes and demonstrate compliance.

Who Signs and Certifies the Questionnaire

Firm CFO

The CFO or controller often completes financial sections, verifies trust accounting controls, and attests to internal segregation of duties. Their signature confirms funds will be handled per written procedures and provides an auditable trail for tax and regulatory reviews.

Managing Partner

A managing partner, general counsel, or designated attorney typically certifies client identity, authorizes distributions from trust accounts, and confirms engagement scope. Their attestation helps establish authority across external parties and is often required for high-value or legally sensitive transactions.

Security and Compliance Controls to Capture

Encryption (Transit): TLS 1.2 and 1.3 encryption
Encryption (At Rest): AES-256 encryption at rest
Certifications: SOC 2 Type II and ISO 27001 certified
HIPAA: Compliant with BAA available
ESIGN / UETA: Meets ESIGN and UETA standards
Audit Trail: Detailed timestamps, IP, action log

Potential Penalties and Risks from Errors

Incorrect 1099: Penalties under IRC §6721
Late Filing: $60–$330 per form
Intentional Disregard: $660+ per form, no cap
I-9 Violations: Civil fines $281–$2,789
Trust Mismanagement: Professional discipline and civil claims
Privacy Breach: HIPAA fines and corrective action

Common Preparation Mistakes to Avoid

  • Using inconsistent naming conventions causes mismatches with government IDs and may trigger tax or banking delays during verification.
  • Failing to collect authorized signer details leads to disputes when funds are disbursed or when third parties request proof of authority.
  • Leaving conditional fields blank or using vague language about fund handling increases legal risk and audit scrutiny.
  • Not retaining signed questionnaires under applicable retention rules hampers audits and can violate HIPAA or tax recordkeeping requirements.

Four Core Elements to Include in the Questionnaire

Core elements to include in a professional Client Trust Questionnaire ensure clear authority, auditable records, and consistent handling of client assets across engagements.

Identity Verification

Require full legal name, date of birth, government ID number, and documentation of residence. Use matching rules to confirm consistency with banking and tax records and reduce identity-related exceptions during onboarding.

Authorized Signers

List all authorized individuals, their titles, limits of authority, and specimen signatures. Include delegation rules and expiration dates to prevent unauthorized disbursements and to support third-party verification when requested.

Fund Controls

Describe trust account details, segregation of funds, dual-approval limits, and reconciliation schedules. Attach bank account verification and internal control descriptions to demonstrate compliance with fiduciary duties.

Audit Trail

Maintain timestamps, IP addresses, signer authentication method, and field-level change history. Store immutable copies of executed questionnaires to support audits, dispute resolution, and regulatory inspections.

Best Practices for Accurate and Efficient Completion

Adopt consistent templates, clear authority language, and strong recordkeeping for Client Trust Questionnaires to reduce risk and simplify audits.

Use standardized template with versioning
Lock templates after legal review, apply version numbers, and document changes. Training staff on template updates prevents ad hoc edits that introduce inconsistency and legal risk. Maintain an approval log for each template revision.
Require dual authorization for disbursements
Set monetary thresholds that require two authorized signers and record both approvals in the questionnaire. Clearly state escalation rules and retention requirements so auditors can trace decision-making and reduce exposure to misappropriation or errors.
Regularly verify signer identity annually
Re-check identity and authority periodically, especially after personnel changes or significant transactions. Use independent verification sources and retain evidence of checks to fulfill due diligence obligations and to support regulatory inquiries or litigation defense.
Archive with secure access controls
Store signed questionnaires in encrypted storage with role-based access, audit logging, and backups. Retention schedules should reflect tax, HIPAA, and state recordkeeping rules; implement legal hold procedures for litigation or regulatory inquiries.

Six Sections Every Complete Questionnaire Should Contain

Six essential sections to include in a comprehensive Client Trust Questionnaire for compliance and operational clarity and recordkeeping practices across engagements.

Client Identity

Collect legal name, date of birth, government ID number, and current address. Include instructions for acceptable ID types and format requirements to avoid mismatches with banks, tax forms, and identity verification services.

Trust Purpose

Describe the purpose and scope of funds held in trust, including transaction types, permitted disbursements, and any limitations. Clear purpose language reduces ambiguity and supports fiduciary compliance across transactions.

Funding Details

List account numbers, bank routing, escrow details, and authorization method. Require bank verification or voided check to prevent misdirected funds and to support reconciliation procedures.

Signer Authority

Specify who may instruct, approve, and sign on behalf of the client or entity, including delegation rules, expiration, and any corporate resolutions or power of attorney documentation.

Compliance Checks

Record results of background checks, sanctions screening, beneficial ownership disclosures, and KYC steps. Attach evidence of checks and document reviewer notes for audit trails.

Retention & Notices

State record retention periods, notice preferences, and consent for electronic communications. Include consumer-facing disclosures when required by ESIGN for financial or healthcare contexts.
