The representations and warranties in this Affidavit shall survive the closing and shall remain enforceable for a period of two (2) years following the date of recording, except to the extent a shorter period is required by applicable law.

10. Amendments; Waiver; Counterparts

This Affidavit may be amended only by a written instrument signed by the parties. No waiver of any provision of this Affidavit shall be effective unless in writing and signed by the party against whom enforcement is sought. This Affidavit may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument.
