Contract for Deed Page 1 of 12 CONTRACT FOR DEED THIS DAY this agreement is entered into by and between ____________________________, hereinafter referred to as "SELLER", whether one or more, and ______________________________, hereinafter referred to as "PURCHASER", whether one or more, on the terms and conditions and for the purposes hereinafter set forth: 1. SALE OF PROPERTY For and in consideration of TEN DOLLARS ($10.00) and other good and valuable considerations the receipt and sufficiency of which is hereby acknowledged, Seller does hereby agree to convey, sell, assign, transfer and set over unto Purchaser, the following property situated in ___________________ County, State of North Carolina, said property being described as follows: See Legal Description Attached as Exhibit A incorporated by reference as though set forth in full Legal Description: Together with all rights of ownership associated with the property, including, but not limited to, all easements and rights benefiting the premises, whether or not such easements and rights are of record, and all tenements, hereditaments, improvements and appurtenances, including all lighting fixtures, plumbing fixtures, shades, venetian blinds, curtain rods, storm windows, storm doors, screens, awnings, if any, and ____________________________________________now on the premises. SUBJECT TO all recorded easements, rights-of-way, conditions, encumbrances and limitations and to all applicable building and use restrictions, zoning laws and ordinances, if any, affecting the
Property as set forth in such recordation, to and upon the premises the purchaser shall pay, first, a deposit in the sum of, to be held by escrow in a private depository in the state of North Carolina at the time of sale, to be transferred to purchaser upon the consummation of the contract by delivery of the property to the purchaser, and, second, after deducting any expenses not mentioned in the contract by the purchaser, the net amount due upon the exercise of the right of purchase, the remainder to be paid upon the termination of any lease or other contractual relationship of seller or purchaser; and, subject to the preceding, if there is no such lease or other contractual relationship, then to be paid upon expiration of the contract or on satisfaction thereof by sale. The provisions of this section shall survive such termination or satisfaction where such termination or acceptance is at the express option of seller. 2. Sale of property for and in consideration of 10, and other good and valuable considerations the receipt and sufficiency of which is hereby acknowledged, purchaser does hereby agree to convey, sell, assign, transfer and set over unto purchaser, the following property situated in county, state of North Carolina, said property being described as follows: also known as “agriculture building," and "mulberry plantation,” situated in county, state of north carolina, there is hereby conveyed and assigned to purchaser without consideration, that part of and parcel of land comprising the “agriculture building" and the premises located to the east and south thereof, and, also known as “mulberry plantation", now known as the "Eden park resort & casino" for the purpose of holding the said farm in lease or in sale, which is commonly known as “big spring," and to convey and assign without consideration to purchaser without consideration and without notice as aforesaid the entire right, title and interest, to said farm in accordance with the agreement of parties and this agreement.
