What a Community Church Movement Agreement Covers

A Community Church Movement Agreement is a legal document that records the transfer, merger, or relocation of a congregation, church property, assets, and associated responsibilities from one church entity to another. It defines the parties, effective date, property and asset inventory, liabilities, staff and volunteer transitions, financial arrangements, and ongoing governance. The agreement also sets out conditions for denominational approvals, conditions precedent, required filings, and any restrictions on future use of property or funds. Properly drafted, it reduces ambiguity and documents consent of church leadership and membership bodies.

Why a Written Movement Agreement Matters

A clear agreement reduces disputes, protects property and restricted funds, and records member and leadership approvals. It documents liabilities, clarifies who assumes obligations, and creates a record for tax, title, and denominational review.

Why a Written Movement Agreement Matters

Who Typically Prepares and Signs This Agreement

Leadership and stakeholders at both transferring and receiving congregations usually prepare and approve the document before execution.

  • Senior clergy and church staff who manage daily operations and provide factual detail.
  • Church board, trustees, or vestry responsible for property and fiduciary decisions.
  • Denominational offices or regional councils that must approve transfers under polity rules.

Denominational authorities and legal counsel commonly review the agreement to verify polity compliance and legal effect.

Key Signer Roles

Senior Pastor

Typically signs as an officer or authorized representative and confirms congregation-level approvals; may also certify pastorate or personnel transitions and execute consent language required by denominational rules.

Board/Trustees

Board members or corporate trustees sign for the incorporated church entity, confirming authority to transfer title and accept liabilities; their signature often triggers recording, insurance updates, and accounting entries.
