Recitals

WHEREAS Community Farm Name: operates an urban agriculture program providing land, tools, and training to members and volunteers; and

WHEREAS Participant Name: seeks to participate in the program and agrees to perform assigned duties and comply with program rules under the terms set forth below; and

NOW, THEREFORE, in consideration of mutual covenants contained herein, the parties agree as follows:

The Participant will engage in activities that support farm operations, including but not limited to planting, weeding, harvesting, compost management, tool maintenance, and participation in community events. Specific duties, expected weekly time commitment, and plot assignments will be set forth below or in attachments.

Either party may terminate this Agreement for cause upon written notice specifying the breach and providing a cure period of days. Either party may also terminate without cause by providing written notice prior to the intended termination date.

Confidentiality

Participant acknowledges that during participation they may learn confidential or proprietary information of the Farm, including but not limited to production techniques, membership lists, donor information, and financial data ("Confidential Information"). Participant agrees not to disclose or use Confidential Information except as necessary to perform duties under this Agreement. This obligation survives termination for a period of two (2) years. Confidential Information does not include information that is publicly available through no breach of this Agreement.

Liability, Waiver and Insurance

Participant assumes all risks associated with participation, including physical injury or property damage. Participant releases, waives and discharges the Farm and its officers, agents and volunteers from liability for claims, demands or causes of action arising out of participation, except to the extent caused by the Farm's gross negligence or willful misconduct. Participant agrees to indemnify and hold harmless the Farm against third-party claims arising from Participant's acts or omissions. Participant is encouraged to maintain personal health and disability insurance.

Rules, Safety and Compliance

Participant will comply with farm rules, safety protocols, and site-specific instructions. Failure to follow safety requirements or repeated violations of farm rules may result in suspension or termination of participation without refund. Participant agrees to use provided personal protective equipment and to report hazards or incidents promptly.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state where the Farm is located, without regard to conflict of law principles.

Entire Agreement

This Agreement, together with any attachments or schedules executed by the parties, constitutes the entire agreement between the parties regarding Participant's participation and supersedes all prior or contemporaneous oral or written agreements. Any modification must be in writing and signed by both parties.
