What the Community Village Agreement Is and when it applies

A Community Village Agreement is a written contract that sets operating rules, membership terms, shared responsibilities, and dispute-resolution procedures for a community-managed environment such as a cohousing village, senior services cooperative, or small intentional community. The agreement defines membership eligibility, assessments or dues, common-area use, governance and voting procedures, and processes for amendment or termination. It is intended to create a predictable legal framework for residents and managers, align expectations, and provide remedies when parties fail to meet obligations. Parties often pair it with bylaws, operating budgets, and community policies.

Why a clear Community Village Agreement matters

A well-drafted agreement reduces conflicts, clarifies financial obligations, and creates enforceable governance rules while preserving member rights. It provides a documented process for admitting and removing members, allocating costs, and resolving disputes, which helps protect community assets and streamline decision-making.

Why a clear Community Village Agreement matters

Who typically prepares and signs this agreement

The Community Village Agreement is used by organizers, community boards, property managers, and prospective or current members as the primary governance and membership contract.

  • Community organizers and boards responsible for drafting governance, budgets, and membership policies.
  • Property managers or cooperative managers who collect dues, schedule maintenance, and enforce community rules.
  • Prospective and current members who must understand financial obligations, voting rights, and exit procedures.

Use this guide to identify the information each participant must provide, the typical approval path, and the documentation that should accompany final execution.

Common signer roles and responsibilities

Community Board

Board members approve bylaws, set assessments, and sign on behalf of the community entity; they must act under the community's governing rules and often carry fiduciary duties to members.

Individual Member

A resident or household that signs to accept membership terms, payment obligations, use rules, and dispute procedures; members should ensure their name and authority match government ID and membership records.

Digital workflow settings to streamline signing

Configure an e-signature workflow that enforces signer order, authentication, and automatic delivery of fully executed copies.

Field Configuration

A standard eSignature workflow moves the document from sender to signer, captures authentication, and preserves a completion record.

  • Upload: Sender uploads the finalized agreement.
  • Place Fields: Assign signature, date, and initial fields.
  • Notify Signers: System sends email or shareable signing link.
  • Archive: Signed PDF and audit trail are saved for records.

Technical and compliance considerations for electronic completion

Choose a platform that supports secure authentication, audit trails, and the export formats you require for record retention.

  • Authentication: Email, SMS, or KBA options
  • Formats: PDF, DOCX export available
  • Integrations: Works with NetSuite, Salesforce, Google Workspace

Common legal and operational risks from errors

Unenforceable Terms: Ambiguous clauses may be struck by courts
Incorrect Signatory: Non-authorized signer can void obligations
Missed Notices: Improper notice can delay remedies or renewals
Payment Disputes: Vague assessment terms trigger collections disputes
Recordkeeping Gaps: Missing executed copies hinder enforcement
Noncompliance: Failure to follow statutory notice rules risks liability

Frequent preparation mistakes to avoid

  • Using imprecise language for payment obligations that leaves timing and remedies undefined, inviting disputes and delayed collections.
  • Failing to confirm signatory authority for entities, which leads to execution defects and possible re-execution requirements.
  • Omitting amendment and notice procedures, causing uncertainty about how changes are adopted or how members are informed.
  • Mixing governance rules with informal practices instead of recording them in the agreement, which damages enforceability and transparency.
