CONFLICT RESOLUTION POLICY

WHEREAS, the Organization seeks to foster a professional environment in which conflicts are addressed promptly, fairly, and with respect for all parties; and

WHEREAS, the Organization recognizes that unresolved disputes may impair workplace operations, employee morale, and contractual relationships, and therefore establishes this policy to provide consistent procedures for resolution; and

WHEREAS, this Conflict Resolution Policy applies to conflicts arising from employment, contractual performance, and other work-related interactions between the Organization and its employees, contractors, volunteers, and third parties as set forth in the Scope below.

Organization Identification

Scope of Policy

This policy governs the processes by which interpersonal, employment-related, and contractual disputes are identified, reported, investigated, and resolved within the Organization and with third parties who are subject to Organization policies or contractual provisions requiring compliance with Organization dispute procedures.

Definitions

For purposes of this policy: "Complainant" means the person initiating the complaint; "Respondent" means the person against whom a complaint is made; "Day" means calendar day unless otherwise stated.

Resolution Procedures

The Organization encourages informal resolution when appropriate but provides a formal process when informal efforts fail or when the nature of the complaint warrants formal review.

Informal Resolution

Parties are encouraged to attempt prompt, direct communication aimed at resolving the matter. Supervisors, managers, or designated mediators may assist in facilitating informal discussions.

Formal Complaint

If informal resolution is unsuccessful or inappropriate, a formal written complaint may be filed with Human Resources or the designated dispute officer. Complaints must state the facts, identify witnesses if any, and specify the relief sought.

Investigation

The Organization will promptly assign an impartial investigator who will gather relevant information, interview parties and witnesses, and document findings. Investigations will be conducted in a timely manner and documented in a written report.

Mediation and Alternative Dispute Resolution

Where appropriate, the Organization may require mediation or other alternative dispute resolution before initiating more formal proceedings. Participation in mediation does not waive the Organization's right to take corrective action when necessary.

Costs and Fees

Unless otherwise agreed in writing, each party will bear its own costs. The Organization may assess administrative fees for formal filings as set forth below.

Term, Review, and Termination

This policy is effective as of the Effective Date and remains in force until amended or rescinded. The Organization will periodically review this policy to ensure ongoing effectiveness.

Confidentiality

All information obtained in connection with a complaint or investigation will be treated as confidential to the maximum extent consistent with the Organization's legal obligations and the need to conduct a fair investigation. Disclosure will be limited to those with a legitimate need to know.

Non-Retaliation

The Organization strictly prohibits retaliation against any individual who, in good faith, files a complaint, participates in an investigation, or assists in resolving a dispute. Alleged retaliation will itself be addressed under this policy.

Recordkeeping

The Organization will maintain records of complaints, investigations, and resolutions in a secure manner for the period specified below.

Governing Law

This policy shall be governed by and construed in accordance with the laws of the jurisdiction identified below, without regard to choice-of-law principles that would refer to the laws of another jurisdiction.

Entire Agreement; Amendment

This policy constitutes the entire understanding between the parties regarding the subject matter herein as between the Organization and its covered persons. Any amendment must be made in writing and signed by an authorized representative of the Organization.

What a Conflict Resolution Policy Is and Why It Matters

The Conflict Resolution Policy is an internal procedural document that defines how disputes involving the organization, its employees, contractors, or third parties will be identified, escalated, and resolved. It sets roles, timelines, formal steps for investigation and mediation, documentation requirements, confidentiality protections, and decision authorities. The policy also describes available informal resolution pathways, formal grievance procedures, and appeal options. When paired with compliant electronic records and audit trails, it supports consistent enforcement, defensible outcomes, and clear record retention aligned with applicable laws and organizational risk controls.

How a Clear Policy Reduces Risk and Improves Consistency

A Conflict Resolution Policy clarifies procedures and responsibilities, reduces inconsistent responses to disputes, preserves evidence, and lowers legal and operational risk. It improves transparency for employees and partners while creating an auditable record of decisions and remedial actions.

How a Clear Policy Reduces Risk and Improves Consistency

Who Uses This Policy and Who Must Follow It

The Conflict Resolution Policy applies to employees, contractors, managers, and designated dispute-resolution officers across the organization.

  • Human resources and people managers responsible for intake, investigation, and corrective action.
  • Legal and compliance teams overseeing policy interpretation, regulatory reporting, and risk mitigation.
  • Executives and department heads who approve remedies and ensure consistent policy application.

External partners and vendors should follow contractually incorporated dispute procedures or the organization's policy where contracts defer to corporate governance.

Core Elements to Include in a Professional Policy

Core sections of a professional Conflict Resolution Policy provide clear scope, escalation paths, roles, timelines, confidentiality, and documentation standards to guide consistent dispute handling.

Scope

Define the types of disputes covered, affected parties, applicable locations, and whether informal or formal procedures apply; clarify exclusions and interactions with collective bargaining agreements, litigation holds, and regulatory reporting obligations.

Roles

Identify intake contacts, investigators, mediators, decision-makers, and appeal authorities; specify delegation of authority, conflict-of-interest rules, and required training or certification for each role to ensure impartiality.

Timelines

Set response deadlines, investigation windows, temporary measures, and appeal periods; include triggers for expedited review and maximum resolution timeframes to meet legal and operational requirements.

Documentation

Require contemporaneous written records, evidence logs, interview notes, and final determinations; define storage location, access controls, retention schedules, and redaction requirements for sensitive information safeguarding.

Confidentiality

Establish confidentiality limits, permitted disclosures to investigators or legal counsel, protections for complainants and witnesses, procedures for handling sensitive records, and consequences for unauthorized disclosures or retaliation.

Remedies

Describe interim remedies, disciplinary actions, corrective measures, restitution, and follow-up monitoring; align remedies with progressive discipline policies and legal compliance requirements, including reassignments, training, and policy revisions.

Step-by-Step: Create and Put the Policy into Practice

Follow these steps to draft, approve, and implement a Conflict Resolution Policy that meets legal and operational requirements.

  • 01
Draft: Gather stakeholders and draft policy language.
  • 02

  • 03
Approve: Obtain executive or board sign-off per authority.
  • 04
Publish: Distribute policy, record acknowledgments, and train staff.

How to Configure an Online Workflow for Approvals and Records

Configure an online policy workflow for routing, e-signatures, and recordkeeping to standardize dispute handling and retention.

Field Configuration
Routing Order Define sequential and parallel approvers
Authentication Level Choose email, SMS code, or SSO
Signature Method Allow electronic signatures compliant with ESIGN/UETA
Retention Tagging Apply retention metadata and access controls

Typical Routing and Filing Process for the Final Policy

Routing a finalized Conflict Resolution Policy to stakeholders and filing locations typically follows a defined electronic workflow.

  • Select Recipients: Enter approvers, reviewers, and distribution lists.
  • Attach Documents: Include supporting records and evidence logs.
  • Sign: Authorized approvers sign electronically with audit trail.
  • Archive: Store final policy and signed records in retention system.

Technical Requirements for Electronic Execution and Storage

Ensure the e-signature platform supports secure authentication, audit trails, and exportable signed records for regulatory compliance and internal audits.

  • Authentication: Email, SMS, or SSO options
  • Security: TLS in transit, AES-256 at rest
  • Integrations: Connectors for ERP, CRM, and storage

Key Dates to Include in the Policy

Include key dates such as policy effective date, review cycles, required acknowledgment deadlines, and retention start dates within the document.

Effective Date:

Date when policy obligations begin

Acknowledgment Deadline:

Employees must sign within 30 days of distribution

Review Cycle:

Annual review or sooner for regulatory changes

Investigation Timelines:

Initial response within 5 business days, report within 30 days

Retention Start:

Common Preparation and Execution Mistakes to Avoid

  • Unclear scope or overlapping policies that cause confusion about which procedure governs a dispute, delaying response and increasing legal exposure.
  • Missing or inconsistent documentation during investigations undermines credibility and can prevent reliable reconstruction of events during audits or litigation.
  • Failure to follow timelines or to provide interim protections may result in harm to parties and regulatory complaints.
  • Inadequate training for investigators and decision-makers increases inconsistent outcomes and elevates the risk of successful challenges to decisions.

Consequences of an Inadequate or Incorrect Policy

Enforceability Risk: Ambiguous policy may be unenforceable.
Regulatory Complaints: Failure to comply can trigger agency investigations.
Increased Costs: Litigation and settlement expenses may rise.
Employee Relations: Reduced morale and retention issues.
Data Exposure: Improper handling risks HIPAA or FERPA breaches.
Sanctions: Court may impose remedies or fines.

Security and Compliance Considerations for Records

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Certifications: SOC 2 Type II and ISO 27001 certified
HIPAA: HIPAA-compliant; Business Associate Agreement required
ESIGN/UETA: Compliance with ESIGN and UETA frameworks
Audit Trail: Immutable timestamps, IP addresses, action logs
Access Control: Role-based permissions and SSO support
