10. Legal Provisions

Indemnification: Applicant shall defend, indemnify and hold harmless the Association, its officers, directors, agents and employees from and against all claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or in connection with the Applicant's construction activities, except to the extent caused by the gross negligence or willful misconduct of the Association.

Compliance and Right to Inspect: The Association reserves the right to inspect the work during reasonable hours and to require correction of any work that fails to conform to approved plans or applicable laws. Failure to comply with approved plans or conditions of approval may result in revocation of approval, stoppage of work, and chargebacks for corrective action.

Default and Remedies: In the event Applicant fails to comply with the terms of this approval, the Association may pursue all available legal and equitable remedies, including completion/repair by the Association and assessment of costs against Applicant or the property owner.

Governing Law: This request and any approval granted hereunder shall be governed by the laws of the state in which the property is located. Venue shall be the appropriate court in the county where the property is located.

Entire Agreement: This form, together with approved plans and any written conditions attached hereto, constitute the entire agreement between the parties regarding the matters set forth herein and supersede prior oral or written communications on the same subject.
