What the Cosigner LOE Document Is

A Cosigner Letter of Explanation (Cosigner LOE Document) is a written statement provided by a loan cosigner to clarify facts or events that may affect a lender's underwriting decision. Typical uses include explaining credit inquiries, gaps in employment, late payments, bankruptcy, or the circumstances behind a missed payment. The document identifies the cosigner, the primary borrower, the loan or account in question, and a concise factual narrative signed and dated by the cosigner. Lenders use the LOE to assess risk and document intent during credit review.

Why a Clear Cosigner LOE Matters

A well-prepared Cosigner LOE provides context lenders need to evaluate risk, reduces delays in underwriting, and preserves the cosigner's credibility by creating a clear, dated record accepted in digital or paper workflows under ESIGN and UETA.

Why a Clear Cosigner LOE Matters

Who Typically Prepares and Reviews a Cosigner LOE

The Cosigner LOE is most often prepared by individuals acting as loan cosigners and reviewed by underwriters, loan officers, and closing agents during credit approval.

  • Cosigners and borrowers — Provide factual statements, dates, and supporting details that explain credit events.
  • Lenders and underwriters — Evaluate the LOE alongside credit reports and supporting documentation to decide risk.
  • Title and closing agents — May require LOE for file completeness before closing on mortgage or consumer loans.

Use concise, factual language and attach supporting documents to help reviewers verify the explanation quickly.

Essential Parts of a Professional Cosigner LOE Document

A complete Cosigner LOE includes identifiable headers, clear parties, factual narrative, dates, supporting attachments, and signature details to ensure the explanation is usable in underwriting and auditable in electronic workflows.

Header

Document title, loan number or reference, and lender name to connect the LOE to the correct file.

Identifying Parties

Cosigner full legal name, borrower full legal name, and contact details for both parties for clear attribution.

Concise Narrative

A factual explanation limited to the specific event, relevant dates, and material circumstances without speculation or opinion.

Supporting Docs

Attach paystubs, bank statements, court discharge documents, or correspondence that corroborate the explanation.

Signature Block

Printed name, signature, and MM/DD/YYYY date; include title (cosigner) and relationship to borrower if relevant.

Distribution Note

List recipients (lender, broker, closing agent) and method of delivery (eSign platform or paper) for auditability.

Required Information and Security Considerations

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Timestamps, IP addresses, and signer actions recorded
Authentication: Email, SMS code, or stronger 2FA options
BAA Availability: HIPAA BAA required for health-related data
Access Controls: Role-based permissions, SSO support
Retention Export: PDF export with certificate of completion

Step-by-Step: Filling Out a Cosigner LOE

Follow these sequential steps to prepare a clear, verifiable Cosigner LOE that integrates with electronic signing and lender review processes.

  • 01
Identify Loan: Record lender name and loan or account number.
  • 02
State Facts: Describe events chronologically and include exact dates.
  • 03
Attach Proof: Add supporting files: statements, discharge letters, or court records.
  • 04
Sign and Date: Sign in ink or eSign and record MM/DD/YYYY.

How to Configure an Online Cosigner LOE Workflow

Set up an eSubmission workflow that captures identity, attachments, and an auditable signature to meet lender requirements and regulatory standards.

Field Configuration
Identity Require email and SMS code or stronger KBA for signer authentication
Conditional Fields Show supporting-document upload when 'Reason' equals bankruptcy or discharge
Attachments Allow PDF, JPG, PNG uploads; enforce max file size
Notifications Send completion emails to lender and cosigner automatically

Typical Routing for a Cosigner LOE

A standard electronic routing sequence ensures the LOE reaches underwriting, is authenticated, and is preserved with an audit trail.

  • Prepare Document: Create LOE and attach supporting files.
  • Assign Signer: Add cosigner email and authentication method.
  • Sign: Cosigner reviews and eSigns the document.
  • Deliver: Platform sends signed copy and audit trail to lender.

Digital Signing and Delivery Requirements

Ensure the eSignature platform supports audit trails, secure storage, and the file formats required by your lender.

  • Supported Formats: PDF, DOCX, and image attachments
  • Integrations: Salesforce, NetSuite, Microsoft 365, Google Workspace
  • Authentication: Email link, SMS code, or KBA options

Typical Timelines and Response Expectations

Timeframes vary by lender; provide the LOE promptly and track submission dates to avoid underwriting delays.

Provide with Application:

Submit LOE when requested by loan officer or as part of initial application.

Lender Response Window:

Many lenders expect supporting LOEs within 3–10 business days.

Notarization Scheduling:

If notarization required, allow 1–7 business days to schedule and complete.

Underwriting Review:

Underwriting may take additional 5–15 business days after receipt of LOE.

Record Start Date:

Retention begins on signing date or loan closing date, whichever is earlier.

Common Mistakes to Avoid

  • Overlong narratives that include irrelevant personal opinion rather than concise factual chronology make verification harder and prolong underwriting.
  • Missing loan reference or borrower name disconnects the LOE from the correct file and can cause submission rejections and delay closing.
  • Uploading low-quality or incomplete supporting documents (blurred statements, cropped discharge papers) prevents underwriters from confirming claims quickly.
  • Using inconsistent names or dates between the LOE and supporting documents can trigger identity or fraud checks and require re-signing.

Risks and Consequences of an Incorrect LOE

Loan Denial: Inaccurate LOEs can lead to underwriting rejection
Closing Delay: Errors cause additional document requests and time
Adverse Pricing: Lender may require higher rate if risk unclear
Tax Impact: Rare; inaccuracies in tax-related statements may trigger review
Identity Flags: Mismatch can trigger fraud investigations
Record Rejection: Unsigned or improperly executed LOEs may be disregarded
