COSMETIC SERVICES AGREEMENT

This Cosmetic Services Agreement ("Agreement") is entered into as of Effective Date: by and between Service Provider Name: whose principal place of business is and Client Name: .

RECITALS

WHEREAS, Service Provider is duly qualified and experienced in performing cosmetic and aesthetic services including but not limited to injectables, laser treatments, chemical peels and skin-rejuvenation procedures; and

WHEREAS, Client desires to engage Service Provider to perform the cosmetic services described herein and acknowledges receipt of pre-treatment disclosures and risk information; and

WHEREAS, the parties desire to set forth their respective rights and obligations with respect to the provision of such services.

NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows:

1. SERVICES

1.1 Scope of Services. Service Provider shall perform the cosmetic services described in the attached Service Description and Treatment Plan or as otherwise agreed in writing by the parties. A general description of the services to be performed is set forth below.

1.2 Schedule and Location. Services shall be provided at the address specified by Service Provider or at the following location: on dates and times agreed by the parties. Estimated duration of each treatment: .

2. FEES, PAYMENT AND CANCELLATION

2.1 Fees. Client shall pay Service Provider the fees set forth below for the Services. Payment is due in accordance with the schedule below.

2.2 Payment Methods and Timing. Payment of all amounts due shall be made by cash, card or other method accepted by Service Provider. Final payment is due upon completion of each treatment unless otherwise agreed in writing.

2.3 Cancellation; No-Show. Client must provide at least notice to cancel or reschedule an appointment. Failure to provide required notice may result in forfeiture of the deposit and/or a cancellation fee equal to .

3. CLIENT REPRESENTATIONS, INFORMED CONSENT AND ACKNOWLEDGEMENTS

3.1 Medical and Personal Information. Client represents that all information provided to Service Provider regarding Client's medical history, medications, allergies, skin conditions and past cosmetic procedures is complete and accurate. Client agrees to update Service Provider of any changes prior to any treatment.

3.2 Age and Capacity. Client represents and warrants that Client is at least 18 years of age and has the full legal capacity to enter into this Agreement. Client affirms: I confirm I am over 18 years of age.

3.3 Informed Consent. Client acknowledges receipt of information regarding the nature of the treatments, expected benefits, likely risks, potential complications and reasonable alternatives. Client consents to receive the services and accepts the risks inherent to cosmetic procedures.

4. PRACTITIONER REPRESENTATIONS

4.1 Qualifications and Compliance. Service Provider represents that the practitioner(s) performing the Services are appropriately trained and, where applicable, hold current and valid licenses or certifications to perform such procedures and will perform services in accordance with prevailing professional standards and applicable statutes and regulations.

5. PHOTOGRAPHY, MARKETING AND CONFIDENTIALITY

5.1 Photographs. Client grants Service Provider the right to take and use clinical photography for purposes of treatment records, quality assurance and promotional materials unless Client affirmatively declines below.

5.2 Confidentiality. Service Provider shall maintain the confidentiality of Client's personal and medical information except as required by law or as necessary to provide the Services. Client authorizes Service Provider to disclose information to medical personnel in the event of an emergency.

6. RISKS, AFTERCARE AND RESULTS

6.1 Risks. Client acknowledges that results cannot be guaranteed and that risks and complications may include, but are not limited to, swelling, bruising, infection, scarring, pigmentary changes, allergic reactions, and unsatisfactory aesthetic results. Client accepts these risks.

6.2 Aftercare. Client agrees to follow all aftercare instructions provided by Service Provider. Failure to follow aftercare instructions may increase the risk of adverse outcomes for which Service Provider shall not be liable.

7. LIABILITY, INDEMNIFICATION AND RELEASE

7.1 Limitation of Liability. Except for gross negligence or willful misconduct, Service Provider's liability for any claim arising out of or relating to this Agreement or the Services shall be limited to direct damages not to exceed the total fees paid by Client to Service Provider under this Agreement for the specific treatment at issue. In no event shall Service Provider be liable for consequential, incidental, special or punitive damages.

7.2 Indemnification. Client shall indemnify, defend and hold harmless Service Provider and its officers, employees and agents from and against any and all claims, liabilities, losses, damages and expenses (including reasonable attorneys' fees) arising out of Client's breach of this Agreement or Client's negligent or willful acts or omissions.

8. TERM AND TERMINATION

8.1 Term. This Agreement shall remain in effect until all obligations between the parties have been performed or until terminated in accordance with this Section.

8.2 Termination for Cause. Either party may terminate this Agreement upon written notice if the other party materially breaches any provision of this Agreement and fails to cure such breach within thirty (30) days after receipt of written notice specifying the breach.

9. NOTICES

9.1 Method. All notices, requests, consents and other communications required or permitted hereunder shall be in writing and delivered by hand, nationally recognized overnight courier, or certified mail, return receipt requested, to the addresses set forth below or as otherwise communicated in writing by either party.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state or jurisdiction in which the Services are performed, without regard to conflict of law principles.

11. ENTIRE AGREEMENT; SEVERABILITY

11.1 Entire Agreement. This Agreement, including any attachments and written treatment plans executed by the parties, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, representations and understandings.

11.2 Severability. If any provision of this Agreement is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect and shall be construed so as to give effect to the parties' intent.

12. AMENDMENTS, WAIVER AND COUNTERPARTS

12.1 Amendments and Waiver. No amendment, modification or waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties. No waiver by either party of any breach shall be deemed a waiver of any subsequent breach.

12.2 Counterparts. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one and the same instrument. Signatures delivered by facsimile or electronic image shall be binding.
