COURT JUDGE AGREEMENT

This Court Judge Agreement (the Agreement) is entered into as of between Court Name: with principal address , and Judge Name: with address .

WHEREAS

WHEREAS, the Court requires the services of a qualified judge to serve as a special, temporary, or pro tempore judge for certain matters as set forth in this Agreement; and

WHEREAS, the Judge is duly qualified, experienced, and willing to accept appointment to provide judicial services on the terms and conditions contained herein; and

WHEREAS, the parties desire to set forth their respective rights, duties, compensation, and procedures with respect to such judicial services.

SCOPE OF WORK

The Judge shall perform judicial services including, but not limited to, presiding over proceedings, issuing rulings and orders, conducting hearings and settlement conferences, preparing findings of fact and conclusions of law where required, and performing such other duties as are consistent with the exercise of judicial functions within the jurisdiction and as requested by the Court. The Judge agrees to perform services in a manner consistent with the ethical obligations and standards applicable to judicial officers.

COMPENSATION AND PAYMENT TERMS

All fees payable under this Agreement shall be subject to submission of an itemized invoice. The Court shall remit payment within the time period described in the Payment Schedule following receipt of a proper invoice. The Judge is responsible for all taxes arising from compensation paid under this Agreement. Reimbursable expenses (if any) must be pre-authorized in writing and supported by receipts.

TERM AND TERMINATION

Term Commencement: This Agreement shall commence on and continue until unless earlier terminated as provided herein.

Either party may terminate this Agreement for convenience upon days' written notice to the other party. The Court may immediately suspend or terminate services for cause, including but not limited to misconduct, failure to perform duties, violation of applicable judicial codes, or material breach of this Agreement.

CONFIDENTIALITY; RECORDS

The Judge shall maintain the confidentiality of all case files, court records, sensitive information, and non-public proceedings as required by law and applicable judicial ethical obligations. The Judge shall not disclose confidential information except as required by law, by court order, or with prior written authorization from the Court. Any notes or draft documents created by the Judge in connection with assigned matters shall be treated as non-public judicial materials in accordance with prevailing rules and retained or disposed of in accordance with Court policy.

CONFLICTS, COMPLIANCE, AND STANDARDS

The Judge represents and warrants that the Judge has no conflict of interest with respect to the matters to be assigned under this Agreement. The Judge shall promptly disclose any potential conflict of interest, prior matter, or other circumstance that could reasonably be perceived to affect impartiality. The Judge shall comply with all applicable laws, rules of conduct, and ethical obligations applicable to judicial officers, including recusal obligations where appropriate.

Acknowledgment of No Conflict: I affirm that, to the best of my knowledge, no conflict exists that would preclude my performance under this Agreement.

INDEMNIFICATION AND INSURANCE

The Judge shall indemnify, defend, and hold harmless the Court and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from the Judge's willful misconduct, gross negligence, or material breach of this Agreement. The Court shall indemnify the Judge for acts undertaken in good faith performance of judicial duties when permitted under governing law.

Insurance: If required by the Court, the Judge shall maintain professional liability or other appropriate insurance and provide proof of coverage prior to commencing services.

GOVERNING LAW; DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to conflict of laws principles. Any dispute arising from this Agreement shall be resolved in the courts of that state or as the parties otherwise agree in writing.

ENTIRE AGREEMENT; AMENDMENT

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, understandings, and agreements. No amendment, modification, or waiver of any provision of this Agreement shall be effective unless it is in writing and signed by both parties.

MISCELLANEOUS

Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Notices required under this Agreement shall be in writing and delivered to the addresses set forth above or such other addresses as the parties may designate in writing.
