What a Court Reporting Agreement Covers

A Court Reporting Agreement is a written contract that sets the terms between a court reporting service and the client ordering reporters, depositions, transcripts, or recordings. It defines scope of services, delivery timelines, rates, transcript ownership, confidentiality, and procedures for corrections or disputes. The agreement helps ensure chain of custody for recordings and transcripts, allocates payment responsibilities, and documents expectations for expedited or certified delivery. Parties typically attach exhibits describing specific proceedings, technical requirements for audio/video, and any HIPAA or confidentiality addenda required for sensitive matters.

Why a Clear Agreement Matters for Court Reporting

A written Court Reporting Agreement reduces disputes about scope, fees, and turnarounds, preserves evidence chain-of-custody, and documents confidentiality and retention obligations. Clear terms protect both the reporting firm and the client when transcripts, audio, or exhibits are later relied upon in litigation or administrative proceedings.

Why a Clear Agreement Matters for Court Reporting

Who Usually Signs a Court Reporting Agreement

Typical signers include parties that schedule or pay for reporting services and the reporting firm itself.

  • Law firms and litigators who order depositions and need certified transcripts for trial or arbitration.
  • Corporate legal departments and compliance teams coordinating internal investigations or regulatory depositions.
  • Independent court reporting agencies or freelance reporters who supply transcript and recording services.

The signer should be the authorized contracting party — the billing contact or an authorized representative — to avoid later disputes over payment or consent.

Step-by-Step: Completing a Court Reporting Agreement

Follow this sequence to build a complete, enforceable agreement and prepare for the first assignment.

  • 01
Prepare template: Use a standard form with editable fields for parties and rates.
  • 02
Fill case details: Enter case caption, docket number, and location.
  • 03
Specify services: Choose reporting type, exhibits handling, and delivery expectations.
  • 04
Sign and distribute: Collect signatures, confirm billing contact, and send fully executed copy to all parties.

Essential Clauses to Include in the Agreement

A professional Court Reporting Agreement should be explicit about rights, duties, and logistics so expectations are clear and enforceable.

Scope of Services

Describe whether services include in-person reporting, remote reporting, realtime feeds, video recordings, and exhibit handling; state any technical specifications for files and formats.

Turnaround and Delivery

Set standard delivery windows for rough and certified transcripts, procedures for expedited requests, and formats for electronic delivery.

Rates and Fees

List hourly or per-page rates, cancellation or rescheduling fees, rush surcharges, and any minimum charges or deposit requirements.

Confidentiality

Include nondisclosure terms for sensitive testimony, handling of privileged material, and any HIPAA-compliant protections when medical information is involved.

Ownership and Use

Clarify who owns raw notes, audio/video recordings, and finalized transcripts, and specify permitted uses and reproduction rights.

Corrections and Certification

Describe the process for transcript correction requests, timelines for errata, and the reporter’s certification language for admissibility.

Common Preparation Mistakes to Avoid

  • Leaving case caption or docket number blank leads to misfiled transcripts and retrieval delays during litigation.
  • Vague service descriptions cause disputes over whether audio/video or realtime access was included in the fee.
  • Omitting billing contact or purchase order number delays invoices and may trigger collections or provider holds.
  • Not specifying expedited fees increases cost disputes when clients request rush transcript delivery at short notice.
