CUSTODY RETAINER AGREEMENT

This Custody Retainer Agreement ("Agreement") is entered into on by and between Client Name: ("Client") and Attorney/Firm Name: ("Attorney").

RECITALS

WHEREAS, Client seeks legal representation concerning custody, visitation, parental rights and responsibilities, or related family-law matters regarding the minor child(ren) identified below; and

WHEREAS, Attorney is willing to provide legal services in such matters on the terms and conditions set forth in this Agreement; and

WHEREAS, the parties desire to set forth their respective rights and obligations with respect to fees, costs, scope of representation, and other terms governing the attorney-client relationship.

NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:

1. SCOPE OF REPRESENTATION

1.1 Engagement. Client retains Attorney to provide legal services related to child custody, parenting time, visitation, and related family-law proceedings for the following child(ren): . Services shall include counsel and representation in negotiation, mediation, and contested hearings as agreed.

1.2 Limitations. Unless expressly agreed in writing, Attorney's representation does not include appeals, criminal defense, child protective services representation, or modification proceedings after judgment is final. Any additional matters require a separate retainer or written amendment.

2. RETAINER, FEES AND BILLING

2.1 Retainer Deposit. Client shall pay an initial retainer deposit of to be held in Attorney's trust account and applied to fees and costs incurred. The retainer is refundable only after final accounting and deduction of billed fees and disbursed costs.

2.2 Hourly Rates and Billing. Attorney's hourly rate for primary counsel is per hour, and the rate for paralegals or other timekeepers is per hour. Time is billed in increments of hour increments. Billing statements will itemize services and time.

2.3 Alternative Fee Arrangement. Select if applicable:

3. COSTS AND EXPENSES

Client shall be responsible for all costs and out-of-pocket expenses related to representation, including but not limited to court filing fees, process service, investigator and expert fees, transcript costs, postage, photocopying, travel, and courier charges. Attorney may require deposit for anticipated costs. Costs are not fees and are separately payable.

4. BILLING PRACTICES; PAYMENT

4.1 Statements. Attorney will provide periodic billing statements itemizing time and costs. Client shall pay amounts due within days of statement date. Retainer deposits will be applied to unpaid invoices when appropriate.

4.2 Late Payments. Unpaid balances may accrue interest at the rate of per month (or the maximum allowed by law), and Attorney may suspend services if invoices are not timely paid.

5. CLIENT COOPERATION

Client agrees to cooperate fully with Attorney, to provide all documents and information relevant to the representation, to be truthful, and to attend scheduled hearings and consultations. Client acknowledges that failure to cooperate may materially impair Attorney's ability to provide effective representation.

6. CONFLICTS; AUTHORIZATION

6.1 Conflicts. Client represents that Client has disclosed all known potential conflicts of interest. If a conflict arises, Attorney will comply with applicable ethical rules and may withdraw if required.

6.2 Authorization to Obtain Records. Client authorizes Attorney to obtain such records as necessary for representation, including medical, educational, employment, and juvenile court records. Client initial to authorize:

7. CONFIDENTIALITY AND PRIVILEGE

Communications between Client and Attorney are privileged. Attorney will take reasonable steps to protect confidential information, except where disclosure is authorized by Client or required by law, court order, or to defend against claims brought by Client against Attorney.

8. TERMINATION; WITHDRAWAL

Client may terminate this Agreement at any time by written notice. Attorney may withdraw for good cause, including nonpayment, failure to cooperate, or conflict of interest, subject to rules of court. Upon termination, Client remains responsible for payment of fees and costs incurred up to the date of termination and for costs associated with orderly transfer of the file.

9. FILES, RECORDS AND RETENTION

Upon conclusion of representation and after payment of outstanding amounts, Attorney will retain the file for a reasonable period. Client may request a copy of the file; reasonable reproduction and retrieval charges may apply.

10. DISPUTE RESOLUTION

The parties agree to make a good faith effort to resolve disputes arising under this Agreement by negotiation. If negotiation fails, parties may submit disputes to mediation or fee dispute resolution procedures as permitted by applicable law. Nothing in this paragraph prevents Attorney from seeking unpaid fees through court proceedings where appropriate.

11. NOTICES

Notices shall be effective upon personal delivery or three (3) days after deposit in the United States mail, postage prepaid, addressed to the notice address provided above, or upon confirmation of electronic delivery where agreed by the parties.

12. GOVERNING LAW; SEVERABILITY; ENTIRE AGREEMENT

12.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to its conflict of laws principles.

12.2 Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Entire Agreement. This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

13. AMENDMENTS; WAIVER; COUNTERPARTS

Any amendment to this Agreement must be in writing and signed by both parties. The failure of either party to enforce any provision shall not constitute a waiver of that provision. This Agreement may be executed in counterparts, each of which shall be deemed an original.

14. ACKNOWLEDGMENT

By signing below, Client acknowledges that Client has read this Agreement, understands its terms, has had an opportunity to ask questions, and consents to the terms of retention, fee arrangements, and scope of representation described herein.
