What the Custom House Sales Agreement Covers

A Custom House Sales Agreement is a written contract that documents the sale of a residential property built or modified to buyer specifications. It sets out the parties, property description, purchase price, deposit and payment schedule, scope of custom work or finishes, delivery and inspection procedures, warranties, transfer of title, and contingencies such as financing or permits. The agreement allocates responsibilities for change orders, timeline adjustments, risk of loss, and closing logistics. Properly drafted, it reduces ambiguity about what is included and how costs, approvals, and defects will be handled between buyer and seller.

Why a Clear Custom House Sales Agreement Matters

A precise agreement protects buyer and seller by documenting expectations on custom specifications, delivery timelines, payment milestones, and remedies for defects or delays. It clarifies allocation of risk and reduces post-closing disputes.

Why a Clear Custom House Sales Agreement Matters

Who Typically Prepares and Signs This Agreement

Parties and professionals involved usually include one or more of the following stakeholders: buyers commissioning custom work, developers or homebuilders, real estate brokers, and construction subcontractors retained to complete custom features.

  • Buyers and purchasers seeking customized finishes, upgrades, or bespoke floor plans.
  • Homebuilders and developers who deliver custom-construction homes or renovation projects.
  • Real estate agents and closing attorneys coordinating contract terms and title transfer.

Each signer should verify authority to contract, confirm scope and pricing, and ensure necessary permits and inspections are referenced before signing.

  • 04

How to Configure an Online Workflow for This Agreement

Initials Place initials at each page and on change orders
Attachment Attach plans, permits, and spec sheets as required documents

Technical Options for Digital Completion and eSubmission

Decide whether to use a cloud eSignature platform, RON notary provider, or in-person notarization based on state and lender requirements.

  • File Formats: PDF, DOCX accepted; use flattened PDFs for final copies
  • Authentication: Email, SMS, or KBA for signer verification; stronger methods for high-value deals
  • Integrations: Connect with CRM, title, or escrow systems such as Salesforce or NetSuite

Ensure the chosen method meets state notarization rules and any lender or title company e-acceptance policies before proceeding.
