What the DACA Application Form Is

The DACA Application Form refers to the set of U.S. Citizenship and Immigration Services forms used to request deferred action under the Deferred Action for Childhood Arrivals policy. Applicants typically submit Form I-821D (Consideration of Deferred Action for Childhood Arrivals) along with Form I-765 (Application for Employment Authorization) and the Form I-765 Worksheet. The packet documents identity, continuous residence, arrival and presence dates, and eligibility factors; supporting evidence and accurate signatures are required for adjudication by USCIS.

Why the Form Matters for Applicants

Completing the DACA Application Form accurately documents an applicant's request for deferred action and, if approved, permits work authorization and temporary protection from removal. Accurate, complete filings reduce the risk of delays or denials and help ensure the applicant's information is properly recorded with USCIS.

Why the Form Matters for Applicants

Who Completes and Reviews DACA Applications

The DACA Application Form is filled out by the applicant or a legal representative and reviewed by USCIS adjudicators; service providers and school officials may supply supporting records.

  • Applicants and family members who prepare identity and continuity evidence for submission and signature.
  • Immigration attorneys or accredited representatives who complete forms, assemble evidence, and advise on eligibility.
  • Nonprofit intake staff and school officials who provide documents like transcripts and attendance records.

Accurate preparation benefits both the applicant and adjudicators by reducing back-and-forth requests, shortening processing time, and preserving an auditable record of the filing.

Core Elements Included in a Complete DACA Application

A professional DACA application bundle organizes required forms, evidence, and signature blocks so USCIS can process the request efficiently.

Primary Forms

Form I-821D, Form I-765, and the I-765 Worksheet assembled in the order USCIS expects to receive them.

Identity Evidence

Government ID copies, birth certificates, and passports that match the applicant name and support the identity claims on the forms.

Continuous Residence

School records, rent receipts, employment records, and affidavits demonstrating continuous presence in the United States since the required date.

Arrival Information

Entries describing how and when the applicant first arrived in the U.S., using exact or best-estimate dates and supporting documents.

Signatures

Clear signature blocks with dated signatures from the applicant and preparer; attestations affirm truthfulness of statements.

Fee Documentation

Payment evidence for required USCIS fees or fee waiver documentation when applicable; organized and clearly labeled.

Step-by-Step: Filling Out the DACA Application Form

Complete the application in a consistent sequence to avoid omissions and ensure supporting records align with entries.

  • 01
Gather Evidence: Collect IDs, school records, medical records, and affidavits supporting continuous residence.
  • 02
Complete Forms: Fill I-821D, I-765, and I-765WS using requested formats and consistent information.
  • 03
Attach Documents: Assemble evidence in the order referenced on the forms with a cover sheet that lists attachments.
  • 04
Sign and Pay: Sign each required spot and include payment or fee waiver documentation before submission.

Where to File and How USCIS Processes Your Submission

Understanding filing destination and the USCIS review flow helps anticipate next steps after submission.

  • Filing Location: Mail the packet to the USCIS filing address specified in current I-821D instructions or file online where permitted.
  • Receipt Notice: USCIS issues a Form I-797 receipt with a tracking number after accepting the package for review.
  • Biometrics: If required, USCIS schedules biometric services for background checks; attend appointments as scheduled.
  • Adjudication: USCIS reviews evidence and issues an approval, denial, or request for evidence (RFE); timelines vary by service center.

Digital Workflow Settings for Online Completion

Configure an online workflow that enforces required fields, collects signatures, and stores an auditable trail.

Field Configuration
Required Fields Mark name, DOB, entry date, and signature as required to prevent incomplete submissions.
Conditional Logic Show supporting evidence upload prompts only when corresponding eligibility boxes are selected.
Authentication Use email plus SMS or knowledge-based verification for higher signer assurance.
Audit Trail Enable immutable timestamps, IP logs, and completion certificates for each signer action.

Digital Signing and Submission Considerations

Electronic submission and signing can streamline the process, but must meet legal and USCIS acceptance requirements.

  • Accepted Formats: PDF and scanned image formats are commonly accepted; follow USCIS file-size and format rules.
  • Authentication: Strong signer authentication reduces fraud risk and supports attribution of signatures.
  • Audit Records: Preserve audit trails, timestamps, and signer contact details for evidentiary support.

When choosing an e-signature workflow for DACA-related documents, ensure the method satisfies ESIGN and UETA principles and that originals or certified copies are retained when USCIS requires them.

Timing and Renewal Guidance

Adhere to USCIS timing guidance to avoid gaps in work authorization and to allow adequate processing time for renewals.

Initial Filing:

File as soon as you are eligible; there is no universal initial filing deadline for DACA requests.

Renewal Window:

USCIS recommends filing renewal requests up to 120 days before current employment authorization expires.

Biometrics Scheduling:

Attend biometric appointments promptly; missed appointments can delay adjudication.

Responding to RFEs:

Provide requested evidence within the timeframe specified in the RFE to avoid denial.

Processing Variability:

Processing times vary by service center; expect differences and plan for potential delays.

Key Milestones in Application Processing

Track these milestones from submission through final decision to maintain control of the timeline.

01

Submission

USCIS receives your packet and issues a receipt notice to begin the case lifecycle.

02

Biometrics Appointment

USCIS or its contractor collects fingerprints and photo for background checks; attend on time.

03

Evidence Review

Adjudicators evaluate submitted documentation and decide whether additional evidence is required.

04

Final Decision

USCIS issues approval, denial, or other final action; approvals include work authorization documentation.

Common Preparation Pitfalls to Avoid

  • Incomplete or inconsistent dates across forms and supporting documents that trigger RFEs or denials.
  • Missing or unsigned forms and preparer sections that cause automatic rejection or delay of the filing.
  • Unsigned evidence or affidavits lacking notarization when USCIS specifically requests notarized statements.
  • Relying on vague or undated documentation rather than contemporaneous, verifiable records of residence or employment.

Consequences of Errors or Misrepresentation

Application Denial: A material omission or inconsistency can lead to denial and require refiling.
Delay in Benefits: Incomplete filings or missed biometrics extend processing time and delay work authorization.
Immigration Risk: Providing false statements can expose applicants to removal proceedings or criminal penalties.
Fee Forfeiture: USCIS may retain submitted fees for denied applications; fee waivers require separate proof.
Loss of Privilege: A denial can affect future discretionary relief requests or related immigration benefits.
Data Exposure: Poor record handling can lead to privacy incidents for sensitive personal information.
