Page 1 of 2 SUPPLEMENTAL RIGHT OF WAY AGREEMENT STATE: COUNTY: The undersigned (“Grantor”), for valuable consideration, the receipt and sufficiency of which is acknowledged, grants, bargains, sells, conveys, and warrants to _____, its successors and assigns, lessees and agents (“Grantee”), an additional Right of Way and Easement _____ feet in width and approximately _____ feet within that existing easement on the la nds of Grantor, as evidenced by the conveyance to _____ dated the _____, recorded in the _____ Records of the _____ County, _____, in Volume _____, Page _____; the terms and conditions of which are ratified, confirmed, and by this reference incorporated into this Supplemental Agreement, on, over, under, and through lands of the Grantor described as follows: (Description of Lands) Grantor covenants that no excavation, building, structure, or other obstructions shall be constructed or permitted on the Right of Way and Easement without Grantee’s prior writ ten consent. Grantee agrees that after construction is completed, it shall, insofar as is practic able to do so, restore the disturbed area to its original condition prior to construction, and to pay Gra ntor for actual damages to crops, timber, livestock, fences, drain tile, and other improvements c aused by the exercise of Grantee’s rights. Grantee agrees that on the termination of this servitude Grantee will remove its improvements (including those installed underground) and will restore the property as near as practical to its original condition. Grantee agrees that it shall not abandon any of the improvements on the property without the prior consent from Grantor, and Grantor’s successors and/or assigns. Grantee agrees to indemnify, defend, and hold Grantor harmless, against any and all claims or demands arising from the negligent construction, installation, operation, or maintenance of the servitude property and the improvements on it. Grantor warrants the title in the lands, conveyed subject to outstanding encumbrances, i f any, now on record in the County. The provisions of this Supplement shall inure to the benefit of and be binding on the parties and their respective heirs, executors, administrators, lessees, agents, successors, a nd assigns.
