What a Diligent Search Request Is and When it’s Used

A Diligent Search Request is a formal record documenting good‑faith efforts to locate a person, entity, or asset when required by law, court rule, contract, or administrative procedure. Typical uses include probate and estate administration, attempts to serve parties for litigation, locating creditors for bankruptcy or tax notices, and verifying last known addresses for governmental notices. The document lists search sources checked, dates and times of each attempt, persons or agencies contacted, and the outcome. It serves both as evidence of effort and as an internal audit trail for compliance purposes.

Why a Diligent Search Request Matters for Compliance and Recordkeeping

A well‑completed Diligent Search Request creates a dated, traceable record that demonstrates reasonable efforts to notify or locate a party and helps satisfy statutory or court notice requirements.

Who Typically Prepares and Relies on a Diligent Search Request

Organizations and professionals who must prove efforts to locate people or entities commonly prepare these requests.

  • Probate attorneys and estate administrators responsible for locating heirs or creditors.

  • Government agencies and compliance teams required to send statutory notices.

The Diligent Search Request is useful to any party that needs a defensible record of search steps and outcomes.

Essential Components of a Professional Diligent Search Request

Include standardized sections so every search is complete, consistent, and legally useful.

Search Scope

Define geographic, temporal, and subject limits clearly. A precise scope explains what was looked for and why broader methods were not used.

Source Inventory

Itemize databases, public records, agencies, and contacts checked. For each source, include query parameters and search dates to enable verification.

Attempts Log

Record every contact attempt with date, time, method, and result. Distinguish successful contacts from negative findings and include screenshots or call notes when available.

Supporting Documents

Attach proof items such as certified mail receipts, database export, screenshots, or declarations from third parties to corroborate search steps.

Certification

Include a signer declaration that the search was performed in good faith, signer name, role, signature, and date to create an evidentiary record.

Privacy Controls

Limit access to PII and record data handling steps. Note any authorizations or legal bases used to access restricted records.

Security and Compliance Elements to Include on the Form

Encryption: AES-256 at rest
Transport Security: TLS 1.2/1.3
Audit Trail: Tamper-evident logs
HIPAA BAA: BAA available
Authentication: Multi-factor options
Certifications: SOC 2 Type II

Practical Tips for Accurate and Efficient Completion

Apply consistent naming, preserve raw evidence, and use authenticated electronic records where permitted to speed review and reduce disputes.

Capture full identifiers
Always record full legal names, dates of birth, and any known aliases. Partial identifiers increase false positives and weaken the search record.
Use multiple sources
Cross-check with at least two independent sources such as public records plus a commercial locator service to improve reliability.
Timestamp contemporaneously
Document findings and save supporting screenshots or receipts at the time of the search to prevent later challenges about timing.
Standardize templates
Maintain a single template for your organization to ensure consistent evidence capture and easier audits.

Timing Considerations and Typical Deadlines

Timing depends on the underlying legal or administrative deadline; begin the search as soon as notice requirements are triggered.

Start Promptly:

Initiate searches immediately upon learning notice is required.

Document Windows:

Record precise query dates and times to show timeliness.

Agency Deadlines:

Meet any statutory notice period tied to the underlying filing or proceeding.

Court Requirements:

Follow court orders or local rules for substituted or published notice timing.

Retention Trigger:

Keep records for applicable statutory retention periods.

Legal Risks and Penalties for Incomplete or Incorrect Searches

Court Sanctions: Negative rulings possible
Vacated Judgments: Judgment may be reopened
Fines: Monetary penalties possible
Delays: Proceedings can be postponed
Privacy Breach: HIPAA or data violations
Evidence Loss: Spoliation risk if not preserved
