What the Discharge Authority Form Is and When it Applies

A Discharge Authority Form is a signed instruction that authorizes release or termination of a recorded interest, lien, or retained obligation — for example, a mortgage or mechanic's lien. The form typically identifies the obligor, secured party, subject property or account, the recording instrument being discharged, and routing instructions for return or recording. Proper completion ensures the county recorder or other filing office can accept and post the release. Many lenders, title companies, and recording offices require a notarized signature or verification of signing authority before recording.

Why a Correct Discharge Authority Form Matters

A correctly executed Discharge Authority Form clears liens, updates title, and prevents future claims; it reduces recording delays and legal uncertainty while documenting authority to release encumbrances.

Why a Correct Discharge Authority Form Matters

Who Typically Prepares and Signs This Form

Use aligns with closing workflows, post-payoff processing, and any situation requiring formal removal of a recorded encumbrance.

  • Lenders and servicers who authorize payoff-based lien releases and instruct recorders.
  • Title companies preparing closing packages and clearing title exceptions.
  • Property owners or borrower representatives submitting discharge requests to recording offices.

Key Roles Who Sign or Approve the Form

Lender Representative

A loan servicing officer or authorized signatory signs on behalf of the secured party; the narrative should state corporate authority, reference loan number, and cite authorization resolution when required.

Borrower / Owner

The property owner or authorized agent may sign to confirm release acceptance or to request a release; agent signatures require a power of attorney or corporate resolution verifying signing authority.

Core Elements to Include on a Professional Discharge Authority Form

A complete form collects identity, instrument reference, recording details, authorization language, signature and notarization blocks, and return/recording instructions for the clerk.

Parties

Full legal names for grantor/grantee and any agent; use names exactly as shown on the recorded instrument to avoid mismatch at the recorder's office.

Instrument Reference

Record book/page or document number, original recording date, and county where the instrument was recorded so the office can locate and link the discharge.

Property Description

Legal description or parcel number as used on the recorded instrument; short addresses alone are often insufficient for title clearance.

Authorization Language

Explicit statement authorizing release or satisfaction of the referenced instrument, including any conditions or effective date of discharge.

Signature & Notary

Signer name, title, printed name, date, and notarization block with notary seal language compatible with the local recorder's requirements.

Return Instructions

Specify where the recorded discharge should be returned or mailed and whether an electronic copy is acceptable for the parties involved.

Step-by-Step: Completing and Submitting a Discharge Authority Form

Follow these core steps to prepare, verify, and submit a discharge for recording.

  • 01
Assemble Documents: Gather the recorded instrument and proof of payoff or satisfaction.
  • 02
Complete Form: Fill all fields exactly and include recording references.
  • 03
Authenticate Signature: Have the signer notarize or provide attestations per local rules.
  • 04
Submit to Recorder: Send form with required fees and return instructions to the county recorder.

Typical Processing Flow for a Discharge Authority

The process commonly moves from authorization to recordation and final return to the requesting party.

  • Authorization: Lender or holder signs and authorizes the discharge.
  • Verification: Servicer confirms payoff and account details.
  • Notarization: Signer obtains notarization if required.
  • Recording: Recorder posts discharge and returns original to designated address.

How to Configure an Online Workflow for Discharge Authority

Set up fields, authentication, and routing to match your internal approval and the recorder's requirements before sending for signature.

Field Configuration
Signers Set roles: Authorized Signer | Agent
Authentication Email link plus SMS OTP or ID verification
Conditional Fields Show notary block only if state requires notarization
Return Routing Auto-send final PDF to title company and recorder

Digital Signing and File Format Considerations

Confirm with the county recorder whether they accept electronic submissions, scanned originals, or require delivery of the paper original.

  • Supported Formats: PDF, DOCX, and image attachments
  • Integrations: Salesforce, NetSuite, Google Workspace
  • Authentication: Email, SMS OTP, or advanced KBA

Common Timelines and Expected Processing Windows

Processing times depend on lender workflows and recorder backlog; plan for buffers between payoff and clear title issuance.

Payoff to Release:

Lender prepares discharge within 3–15 business days after funds clear.

Recorder Posting:

County recording turnaround typically 1–30 business days depending on jurisdiction.

Return of Recorded:

Allow 5–30 business days for mailed return or expedited electronic return.

Payoff Expiry:

Payoff statements often expire in 10–30 days; verify lender expiration terms.

Request Follow-up:

If not recorded within expected window, follow up with lender and recorder.

Key Milestones from Payoff to Final Recording

Track these stages to monitor progress and anticipate follow-up needs.

01

Payoff Posted

Servicer posts payoff and issues satisfaction request to the lienholder.

02

Discharge Prepared

Authorized party completes discharge and obtains required attestations.

03

Document Notarized

If required, signer completes notarization or RON session.

04

Recorded & Returned

County recorder posts instrument and returns the recorded copy to the designated recipient.

Common Errors That Cause Recording Delays or Rejection

  • Using an incorrect legal name that does not match the recorded instrument leads to rejection and re-submission delays with potential costs.
  • Omitting exact instrument reference (book/page or recording number) forces clerks to search and may return the form as unrecordable.
  • Failing to obtain required notarization or remote online notarization produces noncompliant submissions and may require a new document.
  • Not providing clear return instructions or insufficient fees causes the recorder to hold the document or return it to the filer without recording.

Risks and Legal Consequences of an Incorrect Discharge

Title Clouding: Remaining lien claims
Recording Rejection: No public record update
Liability Exposure: Potential wrongful release claims
Delay Costs: Added fees and closing postponement
Regulatory Issues: Noncompliance with state filing rules
Fraud Risk: Unauthorized releases risk criminal penalties
