For consideration received, and in return for the use, today and on all future dates of the property, facilities and services of Manager, Rider, Rider's heirs, assigns, and representatives, hereby agree as follows: 1. Inherent Risks and Assumption of Risk. The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability. Rider acknowledges that horses, by their very nature are unpredictable and subject to animal whim. Rider assumes all risks in connection therewith, and expressly waives any claims for any injury or loss arising therefrom. Rider agrees to abide by and follow Manager's rules and regulations which, shall be posted and/or available from time to time. Rider further acknowledges that the behavior of any animal is contingent to some extent upon the ability of Rider. Rider assumes all risks therefor and warrants a full and fair disclosure of Rider's abilities has been made to Manager. Rider expressly releases Manager from any and all claims for personal injury or property damage, even if caused by negligence (if allowed by the laws of this State) by Manager or its representatives, agents or employees. Of dangerous conditions. In consideration of the risks associated with rider being on and/or entering this property, manager hereby instructs rider to use extreme care and common sense in the operation of any motorized or unpowered machine, including any vehicle or conveyance. Rider's use of any motorized or unpowered machine may be hazardous to the property. Rider agrees that, should the use of any motorized or unpowered machine result in, an injury to or death to the person or persons on the property, or any other injury to or death of any equine participant or to or injury or damage to any property whatsoever by, incidental to, or in any manner connected with rider's use of any motorized or unpowered machine, this rider shall indemnify and hold harmless manager and all partners, employees, officers, directors, investors or creditors of manager, and from any and all costs, liabilities and expenses, including attorney's fees, which may be incurred for such injuries, deaths, or damages. 2. Horse and rider. Manager recognizes that the horses and riders in the facility are under the direct and continuous supervision of the veterinarian and that the horses and horse(s) are under the direct and continuous care of rider and the manager is fully aware of the responsibilities and liabilities associated with the equine activities in connection with this property and facility. Accordingly, rider shall wear an approved helmet or protective helmet while riding as a horse. Manager agrees that neither rider nor horse will be allowed to come within 20 yards of any person or building without the specific permission of manager in writing, signed by the manager. 3. Security; access. Rider shall agree that he or she will not approach or enter the property without permission of manager or at any time during the day without reasonable notice to manager, nor without permission from manager. 4. Roster, conduct; racing. Rider and horse have entered into an agreement with the manager providing for a rider license and horse license, respectively. Rider acknowledges that the rider, rider's heirs, assigns, and representatives under any contractual relationship with manager waive any privilege, right or immunity granted by common or otherwise to him, her or them to participate in any horse, horse activity or associated activity without prior written approval from manager, and that no such rider shall ride or be present in the vicinity of any race without such prior written approval from manager. 5. Roster, conduct and racing. As a condition of continued rider or horse activities, rider understands that he or she will be required to sign a standard rider and horse roster and.
